CHAPTER Ⅰ GENERAL PROVISIONS

Article 1 (Purpose)

The purpose of this Act is to secure the safe and smooth stream of traffic by preventing or removing all traffic dangers and obstacles which may occur on the roads.

Article 1

Article 2 (Definitions)

1. The term “roads” means the roads as provided for in the Road Act, the toll roads as provided for in the Toll Road Act, and all other public places used for general traffic;

2. The term “motor exclusive road” means a road built for the sole purpose of being used for motor vehicular traffic;

3. The term “expressway” means the roads designated for use only by high speed motor vehicular traffic;

4. The term “vehicular road” means a part of road for using by various types of motor vehicles, demarcated by curbstone lines (connected with stones, etc., and dividing a road into vehicular road and sidewalk; hereinafter the same shall apply), safety marks or other similar structures;

4-2. The term “central line” means a line indicated on a road with a safety mark, such as solid yellow or dotted line, or any facilities installed with a median strip, iron rail, fence,

etc., to distinguish clearly the passage of vehicles and horses by direction, and if a changeable vehicular road is marked off under the latter part of Article 13 (1), it means the foremost left yellow dotted line in the advancing direction, indicated by the signal apparatus;

4-3. The term “vehicular way” means a part of the vehicular road which is divided by a lane, so that vehicles and horses pass along a given part of the road in a straight line;

4-4. The term “lane” means a line indicating with a safety mark which creates a boundary between two vehicular roads in order to distinguish them;

5. The term “bicycle track” means a part of the road designated for cyclists, demarcated by safety marks, fences for prevention of danger or other similar structures;

6. The term “sidewalk” means a part of the road designated for pedestrians, (including baby carriages and wheelchairs for the physically handicapped; hereinafter the same shall apply) demarcated by curbstone lines, safety marks or other similar structures;

7. The term “road-side zone” means the side part of the road which is not divided into the sidewalk and vehicular road, and is demarcated by safety marks, etc., for the purpose of securing a safe passage for pedestrians;

8. The term “pedestrian crossing” means a part of the road indicated by safety marks designed to help pedestrians cross the road;

9. The term “intersection” means a junction of roads (vehicular roads in a case where they are distinguished from sidewalks) where two or more roads join together, such as cross roads, or J-shaped roads;

10. The term “safety zone” means a part of the road indicated by safety marks or other similar structures in order to secure the safety of pedestrians crossing or vehicles and horses passing the roads;

11. The term “signal apparatus” means devices operated manually or by electric power, designed to indicate the signals of go, stop, turn, caution, etc., by letters, marks, or lights with respect to road traffic;

12. The term “safety mark” means signposts indicating caution, rule, instruction or guidance, etc., or marks, letters or lines drawn on the surface of roads, which are necessary for traffic safety;

13. The term “vehicles and horses” means vehicles, cattle, and horses. The term “vehicles” means motor vehicles, construction machines, motor bicycles, bicycles or those driven on the roads by means of force from a person or animal, or other power (excluding baby carriages, wheelchairs for the

physically handicappd, and thos drivn on rail or wiring). The term “cattle and horses” means domestic animals used for traffic or transportation;

14. The term “motor vehicles” means vehicles (trailers are also considered to be a part thereof) being driven by motor without using rail or wiring, and falling under the categories of motor vehicles for riding, omnibuses, trucks, special motor vehicles, two-wheeled vehicles under Article 3 of the Automobile Management Act, and construction machines as prescribed in the proviso of Article 26 (1) of the Construction Machinery Management Act: Provided, That the same shall not apply to the motor bicycles as referred to in subparagraph 15;

15. The term “motor bicycle” means a two-wheeled vehicle equipped with a piston displacement which is less than 125 cc., as prescribed in Article 3 of the Automobile Management Act, and a vehicle which a motor of less than 50 cc. is fixed;

16. The term “emergency motor vehicles” means fire trucks, ambulances, and other motor vehicles as provided for by the Presidential Decree, which are used for primary emergency purposes;

16-2. The term “school bus” means motor vehicle of the kindergarten, elementary school or special school under the Education Act, of infant caring facility under the Infant Care Act, or of private teaching institute which mainly aims to

teach children (defined as persns under thirteen years of age; hereinafter the same shall apply.) from among the institutes established under the Act on the Establishment and Operation of Private Teaching Institutes, and which are reported under Article 48-4.

17. The term “parking” means a state in which a vehicle keeps stopping to wait for passengers, to load freight, or for any mechanical failure or other reasons, or in which it may not immediately be driven because the driver is away from his vehicle;

18. The term “stop” means a state in which a vehicle stops for not exceeding five minutes, other than that of parking;

19. The term “driving” means to use vehicles (including the operation) on the roads in accordance with the proper manner of their use;

20. The term “slow-down” means a state in which vehicles are moving at such a slow speed that they will be able to stop immediately;

21. The term “overtaking” means a vehicle passes by and advances to the front of another vehicle ahead;

22. The term “temporary stop” means a state in which a vehicle stops with its wheels completely stopped; and

“exclusive pedestrians road” means a road indicated by safety marks or other similar installations for the sole purpose of being used for pedestrians.

Article 3 (Installation and Control of Signal Apparatus, etc.)

(1) Whenever the Seoul Special Metropolitan City Mayor, Metropolitan City Mayor, or head of Si/Gun (excluding the head of Gun in Metropolitan City, hereinafter referred to as the “Mayor, etc.”) deems it necessary for preventing any danger on the roads and securing a safe and smooth flow of traffic, he shall install and control signal apparatus and safety marks: Provided, That for toll roads, as provided for in Article 12 of the Toll Road Act, the managers of the roads shall install and manage them according to the instruction of the Mayor, etc. <Amended by Act No. 4369, May 31, 1991; Act No. 4518, Dec. 8, 1992; Act No. 4872, Jan. 5, 1995; Act No. 5405, Aug. 30, 1997>

(2) The Do may assist with the whole, or part of the expenses required for installing and managing the signal apparatus and safety marks installed and managed by the head of Si/Gun under paragraph (1). <Newly Inserted by Act No. 4872, Jan. 5, 1995>

Article 3-2 (Encumbrance, etc. for Expenses)

(1) If it is required to remove or restore to its original state any signal apparatus and safety marks established on roads, due to such reason as prescribed by the Presidential Decree, the Mayor, etc. may have the person who has created this situation to pay

all or part of the expense required for such works, in conformity with such standards as determined by the Ordinance of the Ministry of Home Affairs. <Amended by Act No. 5405, Aug. 30, 1997>

(2) If the charges as referred to in paragraph (1) are not paid within a designated period, it shall be collected according to the examples of the disposition on default of local taxes.

Article 4 (Kinds of Signal Apparatus, etc.)

Kinds, manufacturing methods, and installation places for the signal apparatus and safety marks, as provided for in Article 3, and other necessary matters shall be determined by the Ordinance of the Ministry of Home Affairs.

Article 5 (Duty to Follow Signals or Directions)

Pedestrians or vehicles and horses passing along the roads shall follow signals or directions indicated by signal apparatus or safety marks, and those given by policemen controlling the traffic (including members of the combat police units; hereinafter the same shall apply), and the person assisting the policemen, as prescribed by the Ordinance of the Ministry of Home Affairs (hereinafter referred to as “policemen, etc.”). <Amended by Act No. 4518, Dec. 8, 1992; Act No. 5405, Aug. 30, 1997>

Article 4 ~ 5

Article 6 (Prohibition of and Restriction on Traffic)

(1) Whenever the Commissioner of the Local Police Agency deems it necessary for preventing any danger on the roads and securing the safe and smooth flow of traffic, he may prohibit or restrict the traffic of pedestrians or vehicles and horses within a prescribed section. <Amended by Act No. 4369, May 31, 1991>

(2) Whenever the chiefs of police stations deem it necessary for preventing any danger on the roads and securing a safe and smooth stream of traffic, they may, after prohibiting or restricting the traffic of pedestrians or vehicles and horses, prohibit or restrict the traffic on the roads by specifying the subjects, sections and period of such prohibition or restriction, after consultation with the managers of roads.

(3) Whenever a policeman deems that urgent action is required for preventing any danger on the roads which may be caused by destruction of a road, an outbreak of fire or other circumstances, he may prohibit or restrict pedestrians, vehicle or horse traffic within the necessary limit.

(4) When the Commissioner of the Local Police Agency has taken such measures as prescribed in paragraph (1), he shall inform the administrative agency which controls the roads. <Amended by Act No. 4369, May 31, 1991>

(5) When the Commissioner of the Local Police Agency or chief of a police station has taken such measures as prescribed in paragraph (1)

or (2, he shall give a public notice thereof under the conditions as prescribed by the Ordinance of the Ministry of Home Affairs. <Amended by Act No. 4369, May 31, 1991>

Article 7 (Measures for Relieving Traffic Jams)

Whenever a policeman deems that a blockage of passage of pedestrians or vehicles and horses is likely to result from an obvious traffic jam, he may take such measures as may be necessary for relieving the traffic jam.

CHAPTER Ⅱ METHODS FOR PASSAGE OF PEDESTRIANS

Article 8 (Pedestrians)

(1) Any pedestrian shall, at any time, pass the sidewalk, on the road which is divided into a sidewalk and a vehicular road, unless he crosses the vehicular road, or it is prohibited to pass the sidewalk due to road work, etc., or there are other inevitable circumstances.

(2) On a road which is not divided into a sidewalk or a vehicular road, the pedestrian shall pass on the left side of the road or the road-side zone.

Article 9 (Passage of Procession, etc.)

(1) Notwithstanding the provisions of Article 8, a parade of students, or a person

who is deemed to be obstructing the passage of pedestrians, and is accordingly prescribed by the Presidential Decree, may pass the vehicular road. In this case, the passage shall be along the right side of the vehicular road.

(2) For a street-parade, in connection with a socially important event, it is permitted to pass down the center of the road.

Article 10 (Crossing of Road)

(1) The Commissioner of the Local Police Agency may construct a pedestrian crossing for the safety of pedestrians crossing a road, in conformity with the standards as determined by the Ordinance of the Ministry of Home Affairs. <Amended by Act No. 4369, May 31, 1991; Act No. 4872, Jan. 5, 1995>

(2) In the case where an underpass, overpass, other road crossing facilities, or the pedestrian crossing as referred to in paragraph (1), is provided, the pedestrian shall use it to cross: Provided, That in the case of physically handicapped persons who are unable to use the road crossing facilities, such as an underpass, overpass, etc., they may cross the road without such road crossing facilities by any way prejudicial to other traffic. <Amended by Act No. 4872, Jan. 5, 1995>

(3) On a road without a pedestrian crossing as referred to in paragraph (1), a pedestrian shall cross the road using the shortest distance.

(4) Except in a case

Article 10

where a pedestrian passes a pedestrian crossing or crosses a road according to signals or signs by signal apparatus or policemen, etc., he shall not cross the road just in front of or behind all vehicles.

(5) On a part of road, in which crossing is prohibited, as indicated by safety marks, etc., no pedestrian shall cross such part.

Article 11 (Protection of Blind, Children, etc.)

(1) Guardians of children shall not allow the children to play on a road which has dense traffic, nor guardians of infants (defined as persons under six years of age; hereinafter the same shall apply) allow the infants to walk alone on such road. <Amended by Act No. 5405, Aug. 30, 1997>

(2) When a blind-man (including persons treated in the same way as the blind; hereinafter the same shall apply) walks on a road, he shall carry with him a white stick.

(3) When a policeman finds a child playing on a road which has dense traffic, an infant walking alone on a road without a guardian, or a blind-man not carrying a white stick, he shall take proper measures to ensure the safety of such child, infant or blind-man.

Article 11-2 (Designation and Management of Children Protection Zone)

(1) If it is deemed

necessary for protecting children from any danger of traffic accident, the Mayor, etc. may take any necessary measures, such as designating a specified section of the roads in and around the kindergartens and the primary schools, as a children protection zone, restricting or prohibiting the passage of any motor vehicles, and the like. <Amended by Act No. 5069, Dec. 29, 1995; Act No. 5405, Aug. 30, 1997>

(2) Matters necessary for the procedure of and criteria for the designation of the children protection zones as referred to in paragraph (1), shall be determined by the Joint Ordinance of the Ministries of Home Affairs, Education, and Transportation and Construction. <Amended by Act No. 5405, Aug. 30, 1997>

(3) Drivers of vehicles or horses shall drive, in the children protection zone, complying with the measures taken under paragraph (1) and paying regard to the safety of children. <Newly Inserted by Act No. 5405, Aug. 30, 1997>

CHAPTER Ⅲ METHODS FOR PASSAGE OF VEHICLES AND HORSES

Article 12 (Classification of Passage)

(1) In a road which

is divided into a sidewalk and a vehicular road, vehicles and horses shall pass on the vehicular road: Provided, That if they enter and leave a place other than the road, they may cross the sidewalk.

(2) In a case as provided for in the proviso of paragraph (1), vehicles and horses shall pause just before crossing a road so as not to obstruct the passage of pedestrians.

(3) Vehicles and horses shall pass along the right side of the center (in the case where a central line is set up, it refers to the central line; hereinafter the same shall apply) of a road (in a case where a road is divided into a sidewalk and a vehicular road, the vehicular road). <Amended by Act No. 4872, Jan. 5, 1995>

(4) Notwithstanding the provisions of paragraph (3), vehicles and horses may pass the center or left side of a road, in a case where they fall under any of the following subparagraphs: <Amended by Act No. 4369, May 31, 1991>

1. When the road has become a one-way road;

2. When it is impossible to pass the right side of the road due to destruction, construction work or other obstacles;

3. When they desire to pass another vehicle ahead on a road, the right side of which is narrower than six meters: Provided, That such passing shall be permitted only when it is possible

to ascertain the left side of the road, and there is no concern to obstruct the traffic in the opposite direction, and overtaking is not prohibited or restricted by a safety mark, etc.;

4. When the width of the right side of the road is insufficient for their passage; and

5. If, considering it necessary, the Commissioner of the Local Police Agency has designated a section and method of passage, in order to prevent traffic dangers at the curved portion of a steep slope, when they pass according to such designation.

(5) Vehicles and horses shall not enter any place where the approach is prohibited by a safety mark, such as a safety zone, etc.. <Amended by Act No. 4872, Jan. 5, 1995>

(6) In a place where a separate bicycle track is provided, bicycles shall pass on such track.

Article 13 (Marking off of Vehicular Ways)

(1) If it is required for the smooth traffic stream of vehicles and horses, the Commissioner of the Local Police Agency may mark off such vehicular ways on a road as prescribed by the Ordinance of the Ministry of Home Affairs. In this case, on a road in which the two-way traffic volume is substantially different depending on the time zone, there may be marked off the changeable vehicular ways, indicating the advancing direction of the vehicular ways, by means of the signal apparatus, in such

(2) Except as provided in this Act or in an order issued under this Act, vehicles and horses shall pass along the vehicular way on a road marked off the vehicular ways: Provided, That when the Commissioner of the Local Police Agency has separately designated the method of passage, they shall pass the road as designated. <Amended by Act No. 4369, May 31, 1991; Act No. 4872, Jan. 5, 1995>

(3) In a case where it is desired to pass a road in which vehicular ways are marked off, if the width of the vehicle is wider than the width of the vehicular way as determined by the Ordinance of the Ministry of Home Affairs, and it might be an obstacle to the safe or smooth flow of traffic, the driver of the motor vehicle shall not pass the road, except in the case where he has obtained permission from the head of the police station having the control over the starting place, under the conditions as prescribed by the Ordinance of the Ministry of Home Affairs. <Newly Inserted by Act No. 4872, Jan. 5, 1995>

(4) Vehicles and horses shall not change their courses at a place where any change of course is specially prohibited by a safety mark, unless there exists an obstacle due to destruction of the road, construction of the road, etc..

Article 13-2 (Marking-off of Exclusive Vehicular Way)

(1) If it is particularly

required for the smooth stream of vehicles, the Mayor, etc. may mark off the exclusive vehicular way (which means the vehicular way where only the vehicle designated on account of its type and number of passengers is permitted to pass; hereinafter the same shall apply) on the road after consultation with the Commissioner of the Local Police Agency, or chief of the police station.

(2) Types of the exclusive vehicular way, vehicles permitted to pass it, and other matters related to an operation of said way shall be prescribed by the Presidential Decree.

(3) No vehicles other than those permitted to pass the exclusive vehicular way under paragraph (2) shall pass the exclusive way concerned: Provided, That this shall not apply to the case as prescribed by the Presidential Decree.

Article 14 (Order of Priority in Passage)

(1) The order of priority in passage among vehicles and horses shall be as follows:

1. Emergency motor vehicles;

2. Vehicles other than emergency motor vehicles;

3. Motor bicycles; and

4. Vehicles and

horses other than motor vehicles an motor bicycles.

(2) The order of priority in passage among motor vehicles other than emergency motor vehicles as provided for in paragraph (1) 2 shall be subject to that of the maximum speed as may be prescribed by the Ordinance of the Ministry of Home Affairs under Article 15 (1).

(3) Matters necessary for the order of priority in passage as referred to in paragraph (1) shall be determined by the Presidential Decree.

Article 15 (Speed of Motor Vehicles, etc.)

(1) The speed of automobiles and motor bicycles (hereinafter referred to as “motor vehicles, etc.”) passing on the roads shall be as prescribed by the Ordinance of the Ministry of Home Affairs.

(2) If the Commissioner of the Local Police Agency deems it necessary for preventing dangers on the roads and securing a safe and smooth traffic flow, he may designate an area or section and restrict therein the speed determined under paragraph (1). <Amended by Act No. 4369, May 31, 1991>

(3) No driver of a motor vehicle, etc. shall drive at a speed exceeding the maximum speed or under the minimum speed as provided for in paragraphs (1) and (2).

Article 16 (Prohibition of Crossing, etc.)

(1) If they are likely to obstruct normal passage of pedestrians or other vehicles and horses, vehicles and horses shall not cross the road, make a U-turn, or move backwards. <Amended by Act No. 4872, Jan. 5, 1995>

(2) If the Commissioner of the Local Police Agency deems it necessary, in particular for preventing dangers on a road and securing a safe and smooth stream of traffic, he may designate a section of the road and prohibit therein a crossing, a making a U-turn or a moving backwards of vehicles and horses. <Amended by Act No. 4369, May 31, 1991; Act No. 4872, Jan. 5, 1995>

(3) When vehicles and horses are about to enter a road from a wayside building or parking area, etc., they shall first stop and then go slow in order to check whether it is safe or not.

Article 17 (Maintenance of Safety Distance)

(1) When all vehicles follow another in order vehicle travelling in the same direction, it shall maintain sufficient interval to avoid any possible collision with the vehicle ahead, in the case where it stops suddenly.

Article 17-2 (Prohibition of Change of Course)

In the event that a driver of any motor vehicle desires to change the course

of the vehicle, if it might obstruct the normal passage of all motor vehicles travelling in the direction in which he desires to change to, he shall not change the course.

Article 17-3 (Prohibition of Sudden Braking)

No driver of any motor vehicle shall make any sudden braking, such as suddenly stopping his motor vehicle, or suddenly reducing the speed, unless it is required for preventing any danger, or it is inevitable.

Article 18 (Duty to Yield Course)

(1) Except in the case of a road which is divided in accordance with the specified classification, all vehicles other than emergency motor vehicles shall yield their course by moving to the right-side edge of the road, when they are followed by another vehicle in prior order of priority in passage, under Article 14.

(2) Even when a vehicle desires to keep travelling at a slower speed than another vehicle following it which is equal or later in the priority order in passing, it shall yield its course by moving to the right-side edge of the road.

Article 17-3 ~ 18

Article 19 (Methods for Overtaking)

(1) If a vehicle desires to overtake another, it shall pass by the left side of the vehicle ahead.

(2) In the case where as provided for in paragraph (1), any vehicles desiring to overtake another shall pay sufficient attention to the traffic in the opposite direction and in front of the vehicle ahead, and pass ahead at a safe speed and in such safe manner as using the direction indicator, light or horn, in consideration of the speed and course of the vehicle ahead and the condition of road. <Amended by Act No. 4872, Jan. 5, 1995>

Article 19-2 (Prohibition of Interference with Overtaking)

If a vehicle which desires to overtake, does it in the way as prescribed in Article 19 or 56 (2), no driver of any motor vehicle shall interfere with the said overtaking, by competing with the vehicle by accelerating the speed, or blocking the way of the overtaking vehicle, etc. <Amended by Act No. 5403, Aug. 30, 1997>

Article 20 (Time of Prohibition of Overtaking)

(1) When a vehicle ahead travels side by side on left side with another one, overtaking shall be prohibited. <Amended by Act No. 4872,

(2) When a vehicle ahead is overtaking or is about to overtake another one, overtaking by the vehicle behind shall be prohibited.

(4) No driver of any vehicle shall overtake another vehicle which stops or is slowing down in accordance with this Act, any order issued under this Act or instructions of policemen, or in order to prevent any danger. <Amended by Act No. 4872, Jan. 5, 1995>

Article 20-2 (Overtaking Prohibited Place)

No driver of any motor vehicle shall overtake another one in the following places:

1. Intersections, in tunnels or on bridges;

2. Curved places of roads;

3. The vicinity of the summits of sloped roads, or the downhill of steep roads; and

4. Areas designated by the Commissioner of the Local Police Agency which are deemed necessary for preventing any danger on roads and securing the safe and smooth stream of traffic.

Article 20-3 (Prohibition of Intrusion)

No driver of any motor vehicle shall intrude in front of another one which stops or is slowing down in compliance with this Act, any order issued under this Act or any instruction of a policeman, or in order to prevent any danger.

Article 21 (Passage at Railroad Crossing)

(1) When a vehicle desires to pass a railroad crossing (hereinafter referred to as “crossing”), it shall stop for a while in front of the crossing and make sure of safety before passing over it: Provided, That when it follows the sign indicated by a signal apparatus, etc., it may pass over without stopping. <Amended by Act No. 4872, Jan. 5, 1995>

(2) No vehicle desiring to pass over a crossing shall enter it, when the crossing gate is lowered or about to be lowered, or while the alarm is sounding.

(3) If a vehicle becomes inoperative in a crossing due to any trouble, etc. in the course of passing the crossing, the driver of the vehicle shall immediately evacuate passengers, and inform any railroad or police official by using an emergency signal, etc., or by other means. <Newly Inserted by Act No. 4872,

Article 20-3 ~ 21

Article 22 (Methods for Passage of Intersection)

(1) When a vehicle desires to turn to the right out of an intersection, it shall slow down in advance to the right side edge of the road, and when turning to the left, to the inside center of the intersection along the center line of the road, respectively: Provided, That in the case of a left turn, at a place designated by the Commissioner of the Local Police Agency, as necessary one, taking into consideration the situation of intersection, it shall pass the outside of center of the intersection. <Amended by Act No. 4369, May 31, 1991; Act No. 4872, Jan. 5, 1995>

(2) When a vehicle has made a sign by hand, direction indicator or light in order to turn right or left pursuant to the provisions of paragraph (1), the vehicle behind shall not obstruct the course of the vehicle having made such a sign. <Amended by Act No. 4872, Jan. 5, 1995>

(3) No a vehicle which desires to enter an intersection in which the traffic is controlled by a signal apparatus, shall enter into such intersection in such cases where the vehicle is forced to stop at the intersection (if a stop line is marked, the portion beyond such stop line) depending on the situation of the vehicle ahead of the course along which the vehicle desires to advance, and thereby it might interfere with the passage of other vehicles. <Newly Inserted by Act No. 4518, Dec. 8, 1992>

(4) Any vehicle desiring

to enter an intersection in which the traffic is not controlled, shall not obstruct the course of other vehicles previously entering the intersection from other roads.

(5) In a case as referred to in paragraph (4), when vehicles with the same priority order in passage are to enter the intersection at the same time, concession shall be made to the vehicle on the right-side road. <Amended by Act No. 4518, Dec. 8, 1992>

(6) Any vehicle desiring to enter an intersection in which the traffic is not controlled, shall slow down, if the width of the road to be crossed is larger than that of the road on which the vehicle is passing, and when there is another vehicle desiring to enter the intersection from a wider road, it shall yield the course to such vehicle.

(7) In a case as referred to in paragraph (6), the provisions of paragraph (5) shall not apply to a vehicle passing the wider road. <Amended by Act No. 4518, Dec. 8, 1992>

(8) In case where any driver of motor vehicle desires to enter an intersection in which the traffic is not controlled and the safety mark indicating temporary stop or yield is installed, he shall stop temporarily or yield the course so as not to obstruct the course of another vehicle, notwithstanding the provisions of paragraphs (4) through (6). <Newly Inserted by Act No. 5405, Aug. 30, 1997>

Article 23 (Priority to Straight-going and Right-turning Vehicles)

Article 23

(1) Notwithstanding the provisions of Article 22 (4), in the case where a driver of any motor vehicle desires to turn left at an intersection, if there is another motor vehicle which has entered the intersection and wishes to go straight or turn right, he shall not obstruct the course of another vehicle.

(2) Any driver of a vehicle who desires to go straight or turn right at an intersection, shall not obstruct the course of another vehicle which has already entered the intersection and is going to turn left.

Article 24 (Protection of Pedestrians)

(1) If a pedestrian passes a pedestrian crossing, the driver of any motor vehicle shall stop temporarily in front of the pedestrian crossing (referred to a stop line at a place where it is marked off) so as not to obstruct the passing of such pedestrian, or not to put him in danger.

(2) If a driver of any motor vehicle desires to turn left or right at an intersection in which the traffic is controlled, he shall not obstruct the passage of pedestrians crossing the road according to a signal or instruction of the signal apparatus, policeman, etc..

Article 24

(3) No driver of any motor vehicle shall obstruct the passage of pedestrians crossing an intersection in which the traffic is not controlled, or a road near the intersection.

(4) When a pedestrian is in a safety zone established on the road, and when a vehicle passes by a pedestrian on a narrow road in which no vehicular road is marked off, the driver of the vehicle shall slow down with a safety distance.

(5) No driver of any motor vehicle shall obstruct the passage of pedestrian crossing the road under Article 10 (3). <Newly Inserted by Act No. 5405, Aug. 30, 1997>

Article 24-2 (Marking Off of Exclusive Pedestrians Road)

(1) The Commissioner of the Local Police Agency or chief of a police station may mark exclusive pedestrians road when he deems it particularly necessary for protection of pedestrians.

(2) No vehicles or horses may pass the exclusive pedestrians road under paragraph (1): Provided, That in case where the Commissioner of the Local Police Agency or chief of a police station deems it particularly necessary, he may allow vehicles or horses to pass said road.

(3) Drivers of the vehicles or horses allowed to pass the exclusive pedestrians road under the proviso of paragraph (2) shall drive at

the pace of pedestrian or stop temporarily so as not to endanger the pedestrian or obstruct the passage of pedestrian.

Article 25 (Priority to Emergency Motor Vehicles)

(1) Notwithstanding the provisions of Article 12 (3), even though it is a case other than that as provided for in Article 12 (4), if it is urgent and unavoidable, the emergency motor vehicles may pass on the left-side of a road.

(2) Notwithstanding a case to be stopped pursuant to the provisions of this Act or an order issued under this Act, the emergency motor vehicles may not stop.

(3) In cases as referred to in paragraph (1) or (2), the driver of the emergency motor vehicle shall pass, with special attention to traffic safety. <Newly Inserted by Act No. 4872, Jan. 5, 1995>

(4) When an emergency motor vehicle approaches at or near the intersection, all other vehicles shall temporarily stop on the right-side edge of the road and avoiding the intersection: Provided, That if the passage of the emergency motor vehicle is obstructed by such stop on the right-side edge in the case of a one-way road, they may stop on the left-side edge.

(5) When an emergency motor vehicle approaches at a place other than that as

provided for in paragraph (4), all other vehicle hall yield the course by moving to the right-side edge of the road: Provided, That if the passage of the emergency motor vehicle is obstructed by such moving toward the right-side edge in the case of a one-way road, they may yield the course by moving toward the left-side edge. <Amended by Act No. 4872, Jan. 5, 1995>

Article 26 (Special Cases to Emergency Motor Vehicles)

The provisions of Articles 15 and 20 through 20-3 shall not apply to the emergency motor vehicles: Provided, That if the speed of emergency motor vehicle is determined separately pursuant to the provisions of Article 15, the provisions of Article 15 shall be applied. <Amended by Act No. 5405, Aug. 30, 1997>

Article 27 (Slow-down Place)

(1) Drivers of all vehicles shall slow down in the area falling under any of the following subparagraphs: <Amended by Act No. 4369, May 31, 1991; Act No. 4872, Jan. 5, 1995>

1. The intersection in which the traffic is not controlled;

2. The vicinity of curved roads;

3. The vicinity of summits of sloped roads;

4. The downhill of steep roads; and

5. Other areas designated

with safety marks, by the Commissioner of the Local Police Agency as being necessary for preventing dangers on the roads and securing a safe and smooth traffic flow.

Article 27-2 (Temporary Stop Place)

The driver of any motor vehicle shall temporarily stop the vehicle at the following places:

1. An intersection in which the traffic is not controlled, and it is impossible to make sure the left and right, or the traffic is heavy; and

2. Areas designated with safety marks, by the Commissioner of the Local Police Agency as being necessary for preventing dangers on the roads and securing a safe and smooth traffic flow.

Article 28 (Prohibition of Stopping and Parking)

Except in such cases as prescribed by this Act, the order issued pursuant to this Act, instruction of policemen, or such a case of temporary stopping for preventing any danger, all vehicles shall not stop or park in the area falling under any of the following subparagraphs, except in the case where a bus stops or parks

to take on, or let off passengers at the stopping place along its operational lane: <Amended by Act No. 4369, May 31, 1991; Act No. 4421, Dec. 14, 1991; Act No. 5405, Aug. 30, 1997>

1. The intersection, pedestrian crossing, sidewalk or crossing of a road divided into vehicular road and sidewalk, except in the case of parking a car in a road parking lot as prescribed by the Parking Lot Act, which stretches between the vehicular road and sidewalk;

2. The area within five meters from the side edge of an intersection or the corner of a road;

3. For a road in which a safety zone is established, the area within ten meters in all directions from the safety zone;

4. The area within ten meters from a place where a post, plate or line indicating a stop for buses is installed: Provided, That this is applicable only when the buses are in operation;

5. The area within ten meters from the side edge of a crossing or pedestrian crossing; and

6. Other areas designated by the Commissioner of the Local Police Agency as being necessary for preventing dangers on the roads and securing a safe and smooth traffic flow.

Article 28

Article 29 (No Parking Areas)

No vehicle shall park in the area falling under any of the following subparagraphs: <Amended by Act No. 4369, May 31, 1991>

1. The area within five meters from a place where fire-fighting machines and equipment are installed;

2. The area within five meters from fire water tanks;

3. The area within five meters from holes for inserting the suction inlet or pipes of fire hydrant or fire water tanks;

4. The area within three meters from the fire alarms;

5. Tunnels and bridges;

6. Where road works are in progress, the area within five meters from both side edges of such working area; and

7. Other areas designated by the Commissioner of the Local Police Agency as being necessary for preventing dangers on the roads and securing a safe and smooth traffic flow.

Article 30 (Methods and Time Limitation of Stopping and Parking)

Necessary matters pertaining to the methods and time limitation of stopping

or parkin on a road, or prohibition of stoppin and parking in a parking lot on the road for all kinds of vehicles shall be determined by the Presidential Decree.

Article 31 (Measures against Violation of Stopping and Parking)

(1) When traffic may be endangered or obstructed by a vehicle stopping or parking in violation of the provisions of Articles 28 through 30, the police officer or public official whom the Mayor, etc. appoints in accordance with the conditions as prescribed by the Presidential Decree (hereinafter referred to as “Si/Gun public officials”) may order the driver or person responsible for management of the vehicle to modify the method of stopping or parking, or to move the vehicle away from the place concerned. <Amended by Act No. 4243, Aug. 1, 1990; Act No. 5405, Aug. 30, 1997>

(2) In the case as referred to in paragraph (1), if the driver or person responsible for management of the vehicle is not on the scene, the chief of a police station or the Mayor, etc. may, at his discretion, modify the method of parking or take necessary measures for such modification within the limit necessary for preventing dangers on the roads and securing a safe and smooth traffic flow, and if it is inevitable, he may have the vehicle moved to a place designated by the competent police station, the chief of the police station or the Mayor, etc. <Amended by Act No. 4243, Aug. 1, 1990; Act No. 5405, Aug. 30, 1997>

(3) When the chief of the police station or the Mayor, etc. has had a vehicle in parking violation moved to a place designated by the competent

police station, or the chief of the police station or the Mayor, etc. under paragraph (2), he shall have the custody of such vehicle with good administrator’s care, and take necessary measures for returning it by informing such custody to the user (defined as the owner or person consigned by the owner with the management of the vehicle; hereinafter the same shall apply) or the driver of the vehicle. <Amended by Act No. 4243, Aug. 1, 1990>

(4) In the case as referred to in paragraph (3), if it is impossible to identify the name and domicile of the user or driver of the vehicle, a public notification shall be given according to a method as may be determined by the Presidential Decree.

(5) Even though any measure or public notification necessary for return is taken or made under paragraphs (3) and (4), if no the user or driver of the vehicle demands the return, even after passing of one month, the chief of the police station or the Mayor, etc. may sell it, or put it out of service under the conditions as prescribed by the Presidential Decree. <Newly Inserted by Act No. 4518, Dec. 8, 1992>

(6) Expenses required for moving, custody, public notification, sale, or putting out of service, etc. of the vehicle in parking violation under paragraphs (2) through (5) shall be borne by the user of the vehicle, and the provisions of Articles 5 and 6 of the Administrative Vicarious Execution Act shall be applicable to the collection of such expenses. <Amended by Act No. 4518, Dec. 8, 1992>

Article 31

(7) In case where a vehicle is sold or put out of service under paragraph (5), if there is any balance after covering the expenses paid for moving, custody, public notification, sale or putting out of service, etc. of such vehicle, it shall be paid to the user of the vehicle: Provided, That if it is impossible to pay it to the user of the vehicle, it shall be deposited under the Deposit Act. <Newly Inserted by Act No. 4518, Dec. 8, 1992>

Article 31-2 (Vicarious Execution of Hauling and Custody Service, etc. of Vehicles)

(1) The chief of the police station or the Mayor, etc. may have a juristic person, organization or individual satisfying the requirements such as manpower, facilities, equipment, etc. as required (hereinafter referred to as “corporation, etc.”) vicariously execute the whole, or part of hauling, custody and return services of vehicles to be hauled under Article 31. <Amended by Act No. 4872, Jan. 5, 1995>

(2) If the chief of the police station or the Mayor, etc. makes the hauling, custody and return services of vehicles to be vicariously executed under paragraph (1), he may order the necessary measures and education for carrying out such services. <Amended by Act No. 4872, Jan. 5, 1995>

(3) The requirement qualifications such as manpower, facilities, equipment, etc., to be satisfied by the corporation, etc. which vicariously executes the hauling, custody and return services of vehicles

under paragraph (1) and other necessary matters shall be determined by the Presidential Decree. <Amended by Act No. 4872, Jan. 5, 1995>

(4) The officer and employee of the corporation, etc. vicariously executing the hauling, custody and return services of vehicles as provided in paragraph (1), who are in charge of such services, shall be considered as public officials as provided in Articles 129 through 132 of the Criminal Act. <Amended by Act No. 4872, Jan. 5, 1995>

Article 32 (Light of Vehicles)

(1) Vehicles operating on the road at night (from sunset to sunrise; hereinafter the same shall apply) shall turn on the motor vehicle’s head-lights, side-lights, tail-lights and other lights under the conditions as may be as prescribed by the Presidential Decree.

(2) When vehicles travel at night in the opposite direction to each other, or follow immediately behind the vehicle ahead, the drivers shall make such necessary operations as dimming the lights, turning them off temporarily, etc. under the conditions as prescribed by the Presidential Decree.

Article 33 (Signals of Vehicles)

(1) When a driver of any motor vehicle turns left or right, crosses a road, makes

a U-turn, slows down, stops, moves backward, or desires to change his course while advancing in the same direction, he shall give a signal with his hand, a direction indicator or light until such action is completed. <Amended by Act No. 4872, Jan. 5, 1995>

(2) The time and method to give a signal under paragraph (1) shall be determined by the Presidential Decree.

Article 34 (Use of Horn)

(1) When the driver of a vehicle passes an intersection, road corner, sloped road or curved road on a mountain where it is impossible to see to the right or left, he shall sound the horn.

(2) If it is necessary for preventing noise in cities, the Commissioner of the Local Police Agency may restrict a driver to use the horn in a specified area under the conditions as may be as prescribed by the Ordinance of the Ministry of Home Affairs. <Amended by Act No. 4369, May 31, 1991>

(3) In the areas other than those in which a horn shall be sounded under paragraph (1), and in the areas in which the use of a horn is restricted under paragraph (2), no driver of a vehicle shall sound the horn, unless it is urgent for preventing any danger.

Article 35 (Method of and Limitation on Boarding or Loading in Vehicles)

(1) Except as permitted by the chief of a police station which exercises control over the area of departure, no driver of a vehicle shall take passengers in or load cargos in excess of such operational safety standard on the number of passengers, loading weight and capacity may be as prescribed by the Presidential Decree.

(2) The driver of any motor vehicle shall take necessary measures, such as opening and closing the door exactly, etc., so that persons on board, or getting on and off the vehicle do not fall down during operation. <Newly Inserted by Act No. 4872, Jan. 5, 1995>

(3) The driver of any motor vehicle shall take necessary measures to tightly fix the freight onto the vehicle so as not to fall off down during operation, such as covering or binding of the freight, etc.. <Newly Inserted by Act No. 4872, Jan. 5, 1995>

(4) No driver of any motor vehicle shall drive a vehicle in a state which might be unsafe, such as driving the motor vehicle with a baby or animal in his arms, or with goods loaded around the driver’s seat, etc.. <Newly Inserted by Act No. 4872, Jan. 5, 1995>

(5) When the Commissioner of the Local Police Agency deems it necessary for preventing danger on the roads and securing a safe and smooth traffic flow, he may restrict the number of passengers, loading weight or capacity for the drivers of vehicles. <Amended

Article 36 (Restriction on Hauling of Vehicles)

Necessary matters pertaining to the method of hauling vehicles and the measure to prevent danger when hauling them shall be determined by the Presidential Decree.

Article 37 (Prohibition of Driving Insufficiently Maintained Vehicles)

No user, person in charge of maintenance, or driver of any vehicle in which such equipment is not sufficiently maintained as prescribed by the Automobile Management Act, the Construction Machinery Management Act or an order issued under the said Act (hereinafter referred to as the “insufficiently maintained vehicles”), shall drive or make others drive it. <Amended by Act No. 3912, Dec. 31, 1986; Act No. 4518, Dec. 8, 1992; Act No. 4561, Jun. 11, 1993; Act No. 5405, Aug. 30, 1997>

Article 38 (Inspection of Vehicles, etc.)

(1) If a vehicle, which is considered to be an insufficiently maintained vehicle, is driven on the road, the policeman shall first make it stop, and then may demand the driver to present the registration certificate or his driver’s license, and may inspect the equipment of the vehicle. <Amended by Act No. 5405, Aug. 30, 1997>

(2) Whenever the

policman finds, as a rsult of th inspction undr paragraph (1) that the maintenance is insufficient, he may make the driver of the vehicle in question, drive it after taking an emergency measure, depending on the degree of insufficient maintenance condition, or keep on driving after designating a section and passing route and prescribing a requirement for preventing dangers, taking into consideration the situation of the roads and traffic: Provided, That if the state of maintenance is not good that any danger may result therefrom, he may take custody of the registration certificate of the vehicle, and order a temporary suspension of driving. <Amended by Act No. 5405, Aug. 30, 1997>

(3) In the case as prescribed in the proviso of paragraph (2), the Commissioner of the Local Police Agency may determine the period necessary for maintenance, and suspend the use of the vehicle:such period shall not exceed ten days. <Amended by Act No. 4369, May 31, 1991>

(4) Necessary matters pertaining to the inspection and suspension under paragraphs (1) through (3) shall be determined by the Presidential Decree.

Article 38-2 (Operation Recorder of Motor Vehicle)

(1) If a motor vehicle is not provided with an operation recorder, or the operation recorder is unusable due to any trouble, etc., any user, person in charge of maintenance or driver of the vehicle as prescribed by the Ordinance of the Ministry of Home Affairs shall not operate the vehicle, or drive it.

(2) Any user of a

vehicle shall record matterss prescribed by the Ordinance of the Ministry of Home Affairs on the record table prepared on the basis of the operation recorder of the vehicle under paragraph (1), and keep it for one year.

Article 39 (Restriction on Similar Marks and Prohibition of Operation)

(1) No person shall make any painting, marking, etc. similar to a traffic control car, criminal investigation car, or emergency car, or giving a sense of aversion, on any motor vehicle, etc., or drive such motor vehicle, etc..

(2) The scope of the painting, marking, etc. as referred to in paragraph (1) shall be determined by the Presidential Decree.

CHAPTER Ⅳ DUTIES OF DRIVERS AND EMPLOYERS, ETC.

Article 40 (Prohibition of Driving, etc. without License)

(1) No person shall drive a motor vehicle, etc. without obtaining a driver’s license from the Commissioner of the Local Police Agency pursuant

to the provisions of Article 68 (including in a case where the effect of the driver’s license is suspended). <Amended by Act No. 4369, May 31, 1991; Act No. 4872, Jan. 5, 1995>

(2) If a person holding no driver’s license, as prescribed in Article 68, desires to practice driving motor vehicles, etc., he shall obtain the permission of the chief of the competent police station under the conditions as prescribed by the Presidential Decree, except in a case where he receives guidance for driving practice from a person who has obtained the permission on the guidance for driving practice under paragraph (3). <Newly Inserted by Act No. 4872, Jan. 5, 1995>

(3) Any person who desires to guide a driving practice for those holding no driver’s license as prescribed in Article 68 (excluding those who establish and operate such private teaching institutes for driving motor vehicles as prescribed by the Act on the Establishment and Operation of Private Teaching Institutes), shall obtain the permission of the chief of the competent police station, under the conditions as prescribed by the Presidential Decree. <Newly Inserted by Act No. 4872, Jan. 5, 1995>

Article 41 (Prohibition of Driving under Intoxication)

(1) No person who is in a drunken condition, shall drive a motor vehicle, etc. (including the construction machinery other than those prescribed by the proviso of Article 26 (1) of the Construction Machinery Management Act; hereinafter the same shall apply

in this Article, and Articles 42, 43 and 107-2). <Amended by Act No. 5405, Aug. 30, 1997>

(2) Whenever a policeman deems it necessary for the safety of traffic and the prevention of danger, or there is a considerable reason to deem that a driver has driven a motor vehicle in a drunken condition in contravention of the provisions of paragraph (1), he may measure the degree of a driver’s intoxication, and the driver shall be subject to such measurement by the policeman. <Amended by Act No. 4872, Jan. 5, 1995>

(3) For a driver who is dissatisfied with the result of measurement as referred to in paragraph (2), on whether he is in a drunken condition, a remeasurement may be carried out using the method of taking blood, etc. with the consent of the driver. <Newly Inserted by Act No. 4872, Jan. 5, 1995>

(4) The criteria of drunken conditions under which the driving is prohibited pursuant to the provisions of paragraph (1), shall be determined by the Presidential Decree.

Article 42 (Prohibition of Driving in Cases of Overwork, etc.)

Except as provided by Article 41, no driver shall drive a motor vehicle, etc. while he is not in a fit state to drive normally due to overwork, disease, influence of drugs (as referred to in narcotics, hemps, psychotropic drugs and other drugs as prescribed by the Ordinance of the Ministry of Home Affairs; hereinafter the same shall apply) and other reasons.

Article 42-2 (Prohibition of Joint Dangerous Act)

No driver of a motor vehicle, etc. shall inflict any injury on other persons, or cause any danger to the traffic, jointly together with two or more other drivers by running two or more vehicles, etc. in a row forward and backward, or right and left, without any justifiable reason.

Article 43 (Measures for Preventing Dangers)

(1) Whenever a policeman deems that a driver is driving a motor vehicle, etc. in contravention of the provisions of Articles 40 through 42, he may temporarily stop the vehicle, and demand the driver to present his driver’s license.

(2) The policeman may order a person who drives a motor vehicle, etc. in contravention of the provisions of Articles 41 and 42, not to drive it until he recovers and has returned to a normal condition and is able to drive, and may take other necessary measures.

Article 44 (Obligation of Safety Driving)

Any driver of a vehicle shall accurately operate the steering system, brakes and other systems of the vehicle, and shall not drive it at such a speed or in such a manner which may cause any danger and obstacle to others, depending on the situation of road traffic and the structure and performance of the vehicle.

Article 43 ~ 44

Article 45 (Safety Driving Managers)

(1) Any person who is the user of a motor vehicle (excluding that for business; hereinafter the same shall apply in this Article and Articles 46 and 47), and who possesses motor vehicles more than the units as prescribed by the Presidential Decree, shall nominate the safety driving managers in order to perform the duty concerning the safety driving of the motor vehicle (excluding that concerning the maintenance of the motor vehicle), and if the safety driving manager is removed, he shall nominate his successor within such period as may be as prescribed by the Presidential Decree.

(2) When the user of a motor vehicle has nominated or removed a safety driving manager under paragraph (1), he shall report it to the chief of a police station having jurisdiction over the domicile of the user under the conditions as prescribed by the Presidential Decree.

(3) When a safety driving manager has violated the provisions of Article 46 or 47, the chief of a competent police station may order the user of the motor vehicle to remove him.

(4) The user of motor vehicle shall, upon receiving an order under paragraph (3), discharge the safety driving manager and nominate his successor within such period as may be as prescribed by the Presidential Decree.

(5) The qualifications for a safety driving supervisor shall be determined by the Presidential Decree.

Article 45

Article 46 (Business of Safety Driving Managers)

(1) The safety driving manager shall order the drivers of motor vehicles to observe the requirements for safety driving of motor vehicles, and supervise the carrying-out of such an order.

(2) The extent of business of the safety driving supervisor as referred to in paragraph (1) shall be determined by the Presidential Decree.

Article 47 (Training of Safety Driving Managers)

In order to smoothly perform the supervisory business pertaining to safety driving under Article 46, the manager of safety driving shall undergo training as prescribed in the Ordinance of the Ministry of Home Affairs.

Article 48 (Matters to be Observed by Drivers)

(1) Any driver of a vehicle shall observe the followings: <Amended by Act No. 4369, May 31, 1991; Act No. 4518, Dec. 8, 1992; Act No. 4872, Jan. 5, 1995; Act No. Aug. 30, 1997>

1. When the vehicle passes a place in which water is stagnant, it shall pass the place in such a manner that the splashing of such stagnant water may not give others any damage;

2. When the driver finds any danger of traffic accident to the children

i such cases where a child or ifat crosses the road, sits, stands or plays on the road without any protector, or a blind man crosses the road with a white stick, or the handicapped who cannot use road crossing facilities such as underpass or over-road bridge, etc. crosses the road, the vehicle shall temporarily stop.

4. The driver shall not drive any vehicle in which the transmissivity of the visible ray of the windowpane is too low as to clearly identify persons boarding the vehicle from a distance of ten meters, or any vehicle equipped with a device detecting the speed measuring instrument or with other device unconformed to such standards as determined by the Ordinance of the Ministry of Home Affairs;

5. The driver shall not obstruct the passage of other vehicles and horses by having any quarrel, dispute, etc. with the owner of another vehicle, etc. left on the road;

6. When a driver leaves his car, he shall safely maintain the condition of stopping for the vehicle by stopping the engine, securing the operation of brake system, etc., and by taking the necessary measures to prevent the vehicle from being driven by others without permission;

7. The driver shall not open the door of a vehicle or get out of it without making sure of safety, and by taking the necessary measures to prevent any passenger from causing any danger

9. No driver shall act without any justifiable cause in such a manner where he suddenly starts the vehicle, etc. in such a way which produces a noise which damages other persons, where he quickly accelerates the speed of the vehicle, or increases the rotation number of the motor without transmitting the power of motor of vehicles, etc. to the wheels;

10. No driver shall operate a vehicle leaving a passenger to do any noisy act, such as dancing in the vehicle enough to be a substantial obstacle to safe driving; and

11. The driver shall observe such matters which are determined to be required for maintaining the safety and order of traffic by the head of the local police office.

(2) No driver of a passenger car for business shall accept any fellow passenger, refuse any passenger, or receive any fare exceeding the authorized one. <Newly Inserted by Act No. 4872, Jan. 5, 1995>

(3) Any person who has obtained the first or second-class ordinary license as prescribed in Article 68 (2), shall drive the vehicle with the sticker “beginner in driving” attached, under the conditions as prescribed by the Ordinance of the Ministry of Home Affairs, for six months after he receives the license. <Newly

(4) Any policeman who has found a vehicle violating the provisions of paragraph (1) 4 shall have the driver of the vehicle remove it on the spot, or order him to take any necessary measures, and if the driver fails to comply with it, the policeman may remove it directly, or take any necessary measures. <Newly Inserted by Act No.4872, Jan. 5, 1995>

Article 48-2 (Special Matters to be Observed by Driver)

(1) When a driver of the vehicle as prescribed by the Ordinance of the Ministry of Home Affairs drives the vehicle, he shall fasten the safety seat belt and make the person sitting in the next seat fasten the safety seat belt (in case of an infant, it is referred to the safety seat belt after mounting an outfit for protecting an infant; hereinafter the same shall apply) unless it is difficult to fasten the safety seat belt due to disease, etc., or there is any reason as prescribed by the Ordinance of the Ministry of Home Affairs.

(2) Any driver of the vehicle shall also call attention of the persons sitting in the seat other than the next seat to fasten their safety seat belt, and in case of a passenger car where an infant sits in the seat other than the next seat of the driver, he shall make the infant fasten the safety seat belt. <Amended by Act No.5405, Aug. 30, 1997>

(3) Any driver of a two-wheeled motor vehicle (including a motor bicycle) shall operate it wearing the life protecting outfit as prescribed

by the Ordinance of the Ministry of Home Affairs, and make persons sitting on the seat wear it.

Article 48-3 (Special Protection of School Bus)

(1) When any school bus stops on the road operating the apparatus such as on-and-off light for indicating that the children or infant is getting on and off, the drivers of the motor vehicles passing the vehicular way on which the school bus stops or the immediate next vehicular way thereof shall stop temporarily, check the safety and slow down before they reach the school bus.

(2) In the case as referred to in paragraph (1), the driver of the motor vehicle moving from the opposite direction in the road where no central line is marked or in one lane road shall also stop temporarily, check the safety and slow down before he reaches the school bus,

(3) Where any school bus with signs that it carries children or infants passes the road, no motor vehicle shall overtake the school bus.

Article 48-4 (Report on School Bus)

(1) Any person

who intends to operate school bus shall report to the competent chief of police station in advance, receive certificate of complete report, and keep it in school bus at any time.

(2) Motor vehicles permitted to be reported as school bus under paragraph (1) shall be limited to the omnibuses as prescribed by the Ordinance of the Ministry of Home Affairs, and which shall satisfy the conditions as prescribed by the Ordinance of the Ministry of Home Affairs in matters related to coating or marking, insurance contract and ownership, etc.

Article 48-5 (Duty of School Bus Driver)

The driver of school bus shall not operate the apparatus as referred to in Article 48-3 (1) except for the case where children or infant gets on or off, nor operate the bus with signs as referred to in Article 48-3 (3) except for the case where he drives the school bus carrying children or infants.

Article 49 (Traffic Safety Education)

(1) Drivers of vehicles, etc. shall receive the traffic safety education under the conditions as may be prescribed by the Ordinance of the Ministry of Home Affairs.

Article 48-5 ~ 49

(2) Any driver of vehicle, etc. who has violated this Act or an order issued under this Act, shall receive a special traffic safety education under the conditions as may be prescribed by the Ordinance of the Ministry of Home Affairs.

Article 50 (Measures on Occurrence of Accidents)

(1) If a person is dead or injured, or property is damaged or destroyed by a traffic of vehicle (hereinafter referred to as the “traffic accident”), the driver and other crew members of the vehicle (hereinafter referred to as “driver, etc.”) shall promptly stop the vehicle and take necessary measures for relieving the victims, etc.

(2) In a case as provided for in paragraph (1), the driver, etc. of the vehicle concerned shall promptly report the site in which the traffic accident has occurred, the toll and degree of injury, damaged and destroyed property, degree of damage, and other measures taken for it, to the policeman on the site, or if there is no policeman on the site, to the nearest police station (including police substation, police box and police detachment; hereinafter the same shall apply): Provided, That this shall not apply in a case where it is obvious that only the running vehicle is damaged, and any necessary measures for prevention of danger and smooth traffic flow on the road are taken. <Amended by Act No. 4872, Jan. 5, 1995>

(3) The policeman who has received a report under paragraph (2), may, if he deems it necessary for relieving the injured and preventing traffic

dangers, order the driver, etc. who has made such a report, to remain at the site until a policeman arrives there.

(4) The policeman may, at the site, give the driver, etc. of the vehicle of which the traffic accident has occurred, an instruction necessary for relieving the injured and securing traffic safety.

(5) Any driver of an emergency motor vehicle, vehicle for transporting the injured or a vehicle for the delivery of mail may, if urgent, have other crew members take the measures or provide a report under paragraphs (1) and (2), and may continue to drive the vehicle.

Article 51 (Prohibition of Interference with Taking Measures on Occurrence of Accidents)

When a traffic accident has occurred, any person aboard the vehicle concerned shall not interfere with the measure taken or report made by the driver, etc. under Article 50 (1) and (2).

Article 52 (Duty of Employer, etc.)

(1) Any person who employs a driver of a vehicle, or who is in the position to control him directly, or any user of a vehicle (hereinafter referred to as “employer, etc.”), he shall always call the driver’s attention and supervise him to observe the provisions of this Act or an order as prescribed by this Act. <Amended

(2) The employer, etc. shall not look knowingly while a disqualified driver as provided in Articles 40 through 42 drives a motor vehicle, etc., or allow such a driver to operate a motor vehicle, etc..

CHAPTER Ⅴ SPECIAL CASES APPLICABLE TO EXPRESSWAY, ETC.

Article 53 (Common Provisions)

The method, etc. for passage of motor vehicles or pedestrians on the expressway and motor exclusive road shall be as prescribed in this Chapter and if there is no provision in this Chapter, it shall be subject to the provisions of Chapters 1 through 4.

Article 54 (Measures for Preventing Dangers, etc.)

When the traffic on an expressway or motor exclusive road is, or might be dangerous or confused by damage or destruction of the road, the occurrence of a traffic accident or any other cause, the policeman may prohibit or temporarily restrict the passage of advancing motor vehicles or order a necessary measure to the drivers of such vehicles concerned, within the limit necessary for preventing such danger or confusion and securing a safe and smooth traffic flow.

Article 55 (Installation and Management of Signal Apparatus, etc.)

Article 53 ~ 55

(1) The manager of an expressway shall install and manage the signal apparatus and safety marks in order to prevent dangers on the expressway and to secure a safe and smooth traffic flow.

(2) When the manager of an expressway desires to install the signal apparatus and safety marks pursuant to the provisions of paragraph (1), he shall consult with the Commissioner of the National Police Agency. <Amended by Act No. 4369, May 31, 1991>

(3) The Commissioner of the National Police Agency may instruct the administrator of an expressway on matters necessary for management of the signal apparatus and safety marks. <Amended by Act No. 4369, May 31, 1991>

Article 56 (Prohibition, etc. of Passage on Sideway)

(1) Except in an overtaking or unavoidable case due to the condition of road and other circumstances, the motor vehicles shall not pass the sideway (referred to as the road shoulder as prescribed by the Road Act; hereinafter the same shall apply), but pass along such vehicular ways on the expressway as prescribed by the Ordinance of the Ministry of Home Affairs:this provision shall not be applicable to the emergency motor vehicles and the vehicles working on the repair and maintenance of the expressway. <Amended by Act No. 4421, Dec. 14, 1991; Act No. 4872, Jan. 5, 1995>

Article 56

(2) If a vehicle desires to pass another one ahead on the expressway, it shall pass safely using a direction indicator, light or horn, on the vehicular way as may be prescribed by the Ordinance of the Ministry of Home Affairs. <Amended by Act No. 4872, Jan. 5, 1995>

Article 56-2 (Marking Off of Exclusive Way in Highway)

(1) If it is deemed particularly necessary for a smooth traffic flow of highways, the Commissioner of the National Police Agency may mark exclusive ways on highways.

(2) The provisions of Article 13-2 (2) and (3) shall apply mutatis mutandis to the exclusive ways under paragraph (1).

Article 57 (Prohibition of Crossing, etc.)

No motor vehicle shall cross, make a U-turn or move backward on the expressway or motor exclusive road: Provided, That for the emergency motor vehicles or the vehicles working on the repair and maintenance of the road, if it is required for preventing or eliminating traffic dangers on the expressway or motor exclusive road, or for vehicles used to carry out emergency work for a traffic accident, and if it is unavoidable to carry out the purpose, this provision shall not be applicable. <Amended by Act No. 4872, Jan. 5, 1995>

Article 58 (Prohibition of Passage, etc.)

Article 56-2 ~ 58

Pedestrians or vehicles and horses, other than motor vehicles (two-wheeled vehicles shall be limited to emergency motor vehicles) shall not pass or cross the expressway or motor exclusive road. <Amended by Act No. 4421, Dec. 14, 1991>

Article 59 (Prohibition of Stopping and Parking)

Except in case where falling under any of the following subparagraphs, no motor vehicle shall stop or park on the expressway or motor exclusive road: Provided, That if it temporarily stops in order to observe the provisions of Acts and subordinate statutes or an instruction from the policeman, or to prevent dangers, this provision shall not be applicable: <Amended by Act No. 4421, Dec. 14, 1991>

1. When it stops or parks at a place in which a demarcation is indicated so as to stop or park, or a stopping place;

2. When it stops or parks at the edge of a road (including the sideway) owing to motor vehicle trouble or another unavoidable reason;

3. When it stops at a tollgate in order to pay the toll;

4. When the manager of a road, stops or parks the vehicle in order to repair, maintain or patrol the expressway or motor exclusive road for which he is responsible; and

5. When a police emergency motor vehicle, stops or parks in order to conduct

a criminal investigation and traffic control, or to perform the duty of police on an expressway or motor exclusive road.

Article 60 (Priority in Entering Expressway)

(1) When a motor vehicle (excluding the emergency motor vehicle) desires to enter an expressway, it shall not obstruct the passage of other motor vehicles travelling on the expressway.

(2) When an emergency motor vehicle is entering an expressway, motor vehicles other than the emergency motor vehicle shall not obstruct such entry of the latter.

Article 61 (Measures in Case of Trouble, etc.)

If it is impossible for a driver of a motor vehicle to operate his car on an expressway or motor road due to motor vehicle trouble or for any other reason, he shall make a sign as may be prescribed by the Ordinance of the Ministry of Home Affairs, and take a necessary measure such as moving the motor vehicle to a place other than the expressway or motor road, etc..

Article 62 (Special Matters to be Observed by Drivers and Passengers)

(1) Notwithstanding the provisions of Article 48-2 (2), any driver of a motor vehicle passing the expressway or motor exclusive road, which is as prescribed by the Ordinance of the Ministry of Home

Affairs, shall make all persons in the vehicle fasten their safety seat belt, unless it is difficult to fasten the safety seat belt due to disease, etc., or there is any reason as prescribed by the Ordinance of the Ministry of Home Affairs. <Amended by Act No. 4243, Aug. 1, 1990>

(2) Matters to be observed specially by the drivers and passengers of motor vehicles on the expressway and motor exclusive road in order to secure a safe and smooth traffic flow, shall be determined by the Ordinance of the Ministry of Home Affairs.

CHAPTER Ⅵ USE OF ROADS

Article 63 (Prohibited Activities)

(1) No person shall operate the signal apparatus without permission, or withdraw, remove or destroy the signal apparatus or safety marks, or obstruct the use of the road by installing signal apparatus, safety marks and other similar structures.

(2) No person shall leave, without permission, on the road such objects as may disturb the traffic.

(3) No person shall perform the act that falls under any of the following subparagraphs: <Amended by Act No. 4369, May 31, 1991>

1. Act of loitering while around on the road under the influence of liquor;

2. Act of lying sitting or standing on a road in such a manner as to be likely to obstruct the traffic;

3. Act of playing games such as catching balls, riding sledges, etc. on a road where the traffic is dense;

4. Act of throwing a stone, glass bottle, metal scrap or other materials which may injure or damage persons or vehicles and horses on a road;

5. Act of throwing objects from vehicles traveling on a road;

6. Act of jumping into, hanging on or jumping down from vehicles running on a road; and

7. Other acts designated by the Commissioner of the Local Police Agency as necessary ones for preventing the traffic dangers.

Article 64 (Reports on Road Construction Works and Safety Measures, etc.)

(1) Any person who desires to execute such works as digging or excavating a road according to an order of the road management administration or other construction work execution administration, shall report the date, section, period, and method of construction work execution, and other necessary matters to the chief

of a competent police station five days bore executing such works: Provided, That if it is urgently required to execute the works owing to a landslide, burst water pipe, etc., he shall first take a proper measure, and provide a report without delay after starting the construction work.

(2) If it is required to lead or instruct the passage of vehicles and horses during the execution of construction work, the person executing the work as referred to in paragraph (1) shall install the signal apparatus or safety marks according to the direction of the chief of the competent police station. <Newly Inserted by Act No. 4872, Jan. 5, 1995>

(3) If the person executing the work as referred to in paragraph (1) has damaged any signal apparatus or safety marks due to the construction work, he shall restore them to the original state under the conditions as prescribed by the Ordinance of the Ministry of Home Affairs. <Newly Inserted by Act No. 4872, Jan. 5, 1995>

Article 65 (Consultation concerning Permission, etc. to Occupy Road)

(1) When a road management administration desires to perform an act falling under any of the following subparagraphs, it shall consult with the Commissioner of the National Police Agency, if the road management administration is the Minister of Construction and Transportation, or with the chief of a competent police station, if it is the Seoul Special Metropolitan City Mayor,

Article 65

Metropolitan City May or Do governor (hereinafter referred to as the “Mayor/Do governor”) or the head of Si/Gun: <Amended by Act No. 4369, May 31, 1991; Act No. 4872, Jan. 5, 1995; Act No. 5405, Aug. 30, 1997>

1. When it desires to permit the occupation of a road under Article 40 of the Road Act, except in the case of the permission on occupation and use of part of the road, and as prescribed by the Ordinance of the Ministry of Home Affairs; and

2. When it desires to prohibit or restrict the passage under Article 53 or 54 of the Road Act.

(2) In the case as referred to in the proviso of paragraph (1) 1, the road management administration shall notify the contents of the permission on occupation and use of the road to the Commissioner of the National Police Agency or the chief of the competent police station, immediately after granting the permission. <Newly Inserted by Act No. 4872, Jan. 5, 1995>

(3) If it is deemed necessary for a safe and smooth traffic flow, the Commissioner of the National Police Agency, or the chief of the competent police station may, upon receiving the notification under paragraph (2), demand the road management administration to take necessary measures. <Newly Inserted by Act No. 4872, Jan. 5, 1995>

Article 66 (Measures against Unlawful Structures)

Article 66

(1) The chief of a police station may order the persons who fall under any of the following subparagraphs, to correct the unlawful act or to eliminate the traffic obstacle resulted from such act:

1. Those who have installed, without permission, the signal apparatus, safety marks, and other similar structures in contravention of the provisions of Article 63 (1);

2. Those who have left objects in contravention of the provisions of Article 63 (2); and

3. Those who have installed a structure, etc. or executed construction work, etc. in contravention of the provisions of Article 40 of the Road Act.

(2) When it is impossible to order a measure under paragraph (1) because the name and domicile of the person falling under paragraph (1) 1 through 3 are unknown, the chief of the police station may directly take such measure. In this case, the removed structure, etc. shall be kept under the custody of the chief of the police station.

(3) The necessary matters pertaining to the custody and disposal of structures, etc. pursuant to the latter part of paragraph (2) shall be determined by the Presidential Decree.

Article 67 (Measures for Preventing Dangers of Roadside Structures, etc.)

Article 67

(1) When the chief of the police station deems that a ground structure or other facility or object on the roadside may cause a traffic danger or evident traffic obstruction, he may order the owner, possessor or manager of such structure, etc. to remove it or take other necessary measures for traffic safety.

(2) In a case as referred to in paragraph (1), if it is impossible to order the measure under paragraph (1) because the name and domicile of the owner, possessor or manager of the structure, etc. are unknown, the chief of the police station may directly take such measure. In this case, the removed structure, etc. shall be kept under the custody of the chief of the police station.

(3) The necessary matters concerning the custody and disposal of structure, etc. pursuant to the provisions of the latter part of paragraph (2) shall be determined by the Presidential Decree.

CHAPTER Ⅶ DRIVER’S LICENSES

Article 68 (Driver’s License)

(1) Any person who desires to drive a motor vehicle, etc., shall obtain a driver’s license from the Commissioner of the Local Police Agency. <Amended by Act No. 4369, May 31, 1991>

(2) The driver’s

1. First-Class License:

License for large-sized vehicles;

License for ordinary vehicles;

License for small-sized vehicles;

License for special vehicles;

2. Second-Class License:

License for ordinary vehicles;

License for small-sized vehicles;

License for motor bicycles; and

3. Driver’s Practice License:

First-class ordinary practice license;

Second-class ordinary practice license.

(3) The Commissioner of the Local Police Agency may attach any necessary condition to the driver’s license, such as limiting the structure

of the motor vehicle, etc. to be driven, depending on the physical conditions or driving ability of the person who is to obtain the driver’s license, under the conditions as prescribed by the Ordinance of the Ministry of Home Affairs. <Newly Inserted by Act No. 4872, Jan. 5, 1995>

(4) The Commissioner of the Local Police Agency may newly attach or change the condition as referred to in paragraph (3), depending on the physical conditions or driving ability of the person who has undergone the aptitude test under Article 74. <Newly Inserted by Act No. 4872, Jan. 5, 1995>

(5) No person who has obtained a second-class driver’s license, shall drive the motor vehicles for business as provided for in the Automobile Transport Business Act.

(6) The kinds of motor vehicles, etc. which may be driven by any person having obtained a driver’s license(excluding the driver’s practice license) under paragraphs (1) and (2), shall be determined by the Ordinance of the Ministry of Home Affairs according to the kinds of motor vehicles, etc. as provided for in the Automobile Management Act and the Construction Machinery Management Act. <Amended by Act No. 3912, Dec. 31, 1986; Act No. 4518, Dec. 8, 1992; Act No. 4561, Jun. 11, 1993; Act No. 4872, Jan. 5, 1995>

Article 68-2 (Driver’s Practice License)

(1) The driver’s practice license shall be in effect for six months after it is granted: Provided, That if the person who has obtained

the river’s practice license, obtains the first or secon-class ordinary license, the driver’s practice license shall become null and void even before the said period expires.

(2) The types of vehicles to be driven by the person who has obtained the driver’s practice license, and other necessary matters, shall be determined by the Ordinance of the Ministry of Home Affairs.

Article 69 (Delivery, etc. of Driver’s License)

(1) Any person who desires to obtain a driver’s license, shall pass an examination for the driver’s license, and the person who has passed it, shall be delivered the driver’s license, under the conditions as prescribed by the Ordinance of the Ministry of Home Affairs. <Amended by Act No. 4872, Jan. 5, 1995>

(2) The driver’s license takes effect after the driver’s license as prescribed in paragraph (1) is delivered to the person himself or his representative. <Newly Inserted by Act No. 4872, Jan. 5, 1995>

Article 70 (Disqualification for Driver’s License)

(1) Any person who falls under any of the following subparagraphs, shall be disqualified from having a driver’s license: <Amended by

1. Person who is under eighteen years of age.:for a motor bicycle, person who is under sixteen years of age;

2. Person who is lunatic, mentally weak or epileptic;

3. Person who is deaf (limited to the first-class driver’s license), blind, or physically handicapped as may be prescribed by the Presidential Decree;

4. Person who is addicted to narcotics, hemp, psychotropic drug or alcohol;

5. Deleted; <by Act No. 4872, Jan. 5, 1995>

6. Person who desires to obtain a first-class license for large-sized vehicles or for special vehicles, but is under twenty-one years of age, or a person who has the experience of driving motor vehicles, etc. (excluding two-wheeled motor vehicles and motor bicycles) for less than one year and six months.

(2) Any person who falls under any of the following subparagraphs, is ineligible for obtaining the driver’s license without the period elapsing as referred to in the following subparagraphs. In this case, in the cases as referred to in subparagraphs 1 through

In a case where he drives a motor vehicle, etc. in contravention of the provisions of Article 40 (1) or (2), two years (in the case of the motor bicycle license, six months) from the day of violation (if the license is cancelled due to driving during the period in which the driver’s license is suspended, the day of such cancellation): Provided, That in a case where he violates the provisions of Article 50 (1) and (2) after killing or injuring any person, it shall be five years from the day of such violation;

2. In a case where he violates the provisions of Article 50 (1) and (2) after he kills or injures any person in contravention of the provisions of Article 41 or 42, five years after his driver’s license is cancelled;

3. In a case where he fails to take the necessary measures and provide a report as prescribed in Article 50 (1) and (2), after he kills or injures any person by any accident other than those as prescribed in Articles 40 through 42, four years after his driver’s license is cancelled;

4. In a case where he has caused three or more times the traffic accidents while driving motor vehicle, etc. in contravention of the provisions of Article 41 (1), three years after his

driver’s license cancelled;

5. In a case where his driver’s license is cancelled by the cause as prescribed in Article 78 (1) 3 and 5, or 6, two years after the license is cancelled;

6. In a case where his driver’s license is cancelled by any cause other than those as referred to in subparagraphs 1 through 5, one year after the license is cancelled, except in the case of a person whose driver’s license is cancelled because he fails to undergo the aptitude test, or a person holding the first-class driver’s license, who fails to pass the aptitude test, and desires to again obtain the second-class driver’s license; and

7. In a case where the effect of his driver’s license is suspended, the suspension disposition period.

Article 71 (Examination, etc. for Driver’s License)

(1) The examination for driver’s license (excluding those for the first and second-class ordinary licenses) shall be conducted by category of driver’s license, by the Commissioner of the Local Police Agency, on the following matters: <Amended by Act No. 4872, Jan. 5, 1995>

1. The aptitude required for driving motor vehicles, etc.;

2. The technical skill required for driving motor vehicles, etc.;

3. The knowledge

of Acts and subordinate statutes relating to motor vehicles, etc. and road traffic; and

4. The operational method and the points of checking up, necessary for the safe driving of motor vehicles, etc.

(2) The examination for the first and second-class ordinary licenses shall be conducted by the Commissioner of the Local Police Agency, by category of driver’s license, for those holding the first or second-class ordinary practice license, on the following matters: <Newly Inserted by Act No. 4872, Jan. 5, 1995>

1. Driving ability on road, required for driving motor vehicles; and

2. Applied knowledge on motor vehicles and road driving.

(3) The method, procedure and other necessary matters pertaining to the examination for driver’s license under paragraphs (1) and (2) shall be determined by the Presidential Decree. <Amended by Act No. 4872, Jan. 5, 1995>

Article 71-2 (Specialized Driver Training School)

(1) In order to raise the educational level on the driving of motor vehicles, and to improve the quality of drivers, the Commissioner of the Local Police Agency may designate a specialized driver training school (hereinafter referred to as “specialized school”) any driver training school registered pursuant to the Act on the Establishment and Operation of Private Teaching

Institutes and who has conformed to the following standards, under the conditions as prescribed by the Ordinance of the Ministry of Home Affairs:

1. A school superintendent (referred to as a person responsible for the education on the curricula and function of the specialized school and the operation of the school affairs; hereinafter the same shall apply) who meets the requirements for qualification as prescribed in Article 71-3, shall be assigned to the school: Provided, That if the founder meets such requirements, he may concurrently hold the office of school superintendent. In this case, a deputy school superintendent assisting the school superintendent shall be assigned;

2. The skill measurement personnel (referred to as a person who conducts the skill measurement as prescribed in Article 71-6; hereinafter the same shall apply) as prescribed in Article 71-4, and instructors (referred to as those who instruct Acts and subordinate statutes and knowledge on the road traffic and technical education, which are necessary for driving a motor vehicle, etc.; hereinafter the same shall apply) as prescribed in Article 71-5, shall be employed in conformity with the standards as determined by the Presidential Decree;

3. It shall provide facilities, equipment, etc. conform to such standards as determined by the Presidential Decree; and

4. The operation

Article 71-2

of the specialized school, such as educatial method, driving ability of those who have completed the full course, etc., shall conform to the criteria as determined by the Presidential Decree.

(2) The Commissioner of the Local Police Agency may not designate as a specialized school the following driver training schools:

1. Any driver training school established and operated by a founder, school superintendent or deputy school superintendent of a specialized school, the designation of which is cancelled under Article 71-10, within three years from the day of cancellation; and

2. In the case where a designation of the specialized school is cancelled under Article 71-10, any driver training school established and operated at the same place within three years from the day of cancellation.

(3) If a specialized school designated under paragraph (1) desires to change any important matters as determined by the Presidential Decree, it shall be approved by the Commissioner of the Local Police Agency having the jurisdiction over the seat thereof.

Article 71-3 (School Superintendent, etc.)

The qualification

Article 71-3

criteria for the school superintendent and the deputy school superintendent shall be as follows:

1. Person who is not less than thirty-five years of age;

2. Person who has a career (limited to the management service career) for three or more years in affairs concerning road traffic, or who has knowledge and experience in the operation of the driver training school, and who does not fall under any of the following items:

(a) Person who falls under subparagraphs of Article 89; and

(b) Person who was sentenced to a penalty heavier than a fine, for violation of the provisions of subparagraphs 1 through 5 of Article 107-2, and for whom three years have not passed after the execution of sentence is terminated or exempted;

3. Person who is a founder, school superintendent, or deputy school superintendent of a specialized school, the designation of which is cancelled under Article 71-10, and for whom three years have not passed after the designation is cancelled.

Article 71-4 (Skill Measurement Personnel)

(1) The qualification

Article 71-4

criteria for the skill measurement personnel shall be as follows:

1. Person who has passed the qualifying examination for skill measurement personnel under the conditions as prescribed by the Ordinance of the Ministry of Home Affairs, and has completed the training course on the driver skill measurement at such specialized organ as designated by the Commissioner of the National Police Agency; and

2. Person who is determined by the Ordinance of the Ministry of Home Affairs, to have the qualification equivalent to or higher than those as referred to in subparagraph 1, with respect to skill measurement, and has completed the training course on the driver skill measurement at such specialized organ as designated by the Commissioner of the National Police Agency.

(2) The Commissioner of the National Police Agency shall deliver the skill measurement personnel qualification certificate to those who have completed the training course as referred to in paragraph (1), under the conditions as prescribed by the Ordinance of the Ministry of Home Affairs.

(3) No person who falls under any of the following subparagraphs, may be the skill measurement personnel:

1. Person who is under thirty years of age;

2. Person who was sentenced to a penalty heavier than imprisonment without

prison labor in violation of the provisions of Article 3 (1) of the Act on Special Cases Concerning the Settlement of Traffic Accidents, or Article 5-3 of the Act on the Aggravated Punishment, etc. of Specific Crimes, and for whom two years have not passed after the execution of such sentence is terminated or exempted;

3. Person who was sentenced to a penalty heavier than imprisonment without prison labor in violation of the provisions of Article 3 (1) of the Act on Special Cases Concerning the Settlement of Traffic Accidents, or Article 5-3 of the Act on the Aggravated Punishment, etc. of Specific Crimes, and is in the period of the suspended sentence;

4. In a case where the qualification for the skill measurement personnel is cancelled under paragraph (4), person for whom three years have not passed after the qualification is cancelled; and

5. Person for whom three years have not passed after he obtains the driver’s license to operate any vehicles used for the skill measurement.

(4) If a skill measurement personnel falls under any of the following subparagraphs, the Commissioner of the Local Police Agency may cancel the qualification for skill measurement personnel in conformity with the criteria as determined by the Ordinance of the Ministry of Home Affairs, or suspend the effect of the qualification with a period fixed within the limit of one year:

Article 71-4

Provided, That in a case where he falls under subparagraphs 1 through 3, the qualification shall be cancelled:

1. Where he falsely attests the fact that he has passed the skill measurement test as prescribed in Article 71-6 (4);

2. Where he has the skill measurement personnel qualification certificate delivered by a false or other illicit way;

3. Where he is sentenced to a penalty (including a suspended sentence) heavier than imprisonment without prison labor for violation of the provisions of Article 3 (1) of the Act on Special Cases Concerning the Settlement of Traffic Accidents, or Article 5-3 of the Act on the Aggravated Punishment, etc. of Specific Crimes;

4. Where he commits any illicit act with respect to affairs of the skill measurement personnel; and

5. Where he fails to complete the training course as prescribed in Article 71-7, without any justifiable reason.

Article 71-5 (Instructor)

(1) The qualification criteria for an instructor shall be as follows:

1. Person who has passed the qualifying examination for instructor under the conditions as prescribed by the Ordinance of the Ministry of Home Affairs, and has completed the training course on the driving of motor vehicles at such specialized organ as designated by the Commissioner of the National Police Agency; and

2. Person who is determined by the Ordinance of the Ministry of Home Affairs, to have the qualification equivalent to or higher than that as referred to in subparagraph 1, with respect to the skill and knowledge on the driving of motor vehicles, and has completed the training course on the driving of motor vehicles at such specialized organ as designated by the Commissioner of the National Police Agency.

(2) The Commissioner of the National Police Agency shall deliver the instructor qualification certificate to those who have completed the training course as referred to in paragraph (1), under the conditions as prescribed by the Ordinance of the Ministry of Home Affairs.

(3) No person who falls under any of the following subparagraphs, may be the instructor:

1. Person who is under twenty-three years of age;

2. Person who was sentenced to a penalty heavier than imprisonment without

4. Person for whom three years have not passed after the instructor qualification certificate is cancelled under paragraph (4); and

5. Person (limited to instructors in charge of skill training) for whom two years have not passed after obtaining the driver’s license to drive any motor vehicles used for the skill training.

(4) If an instructor falls under any of the following subparagraphs, the Commissioner of the Local Police Agency may cancel the qualification as instructor in conformity with the criteria as determined by the Ordinance of the Ministry of Home Affairs, or suspend its effect with a period fixed to a limit of one year: Provided, That if he falls under subparagraph 1 or 2, the qualification shall be cancelled:

Article 71-5

1. Where he has the instructor qualification certificate delivered in a false or illicit way;

2. Where he is sentenced to a penalty heavier than imprisonment without prison labor (including a suspended sentence) in violation of the provisions of Article 3 (1) of the Act on Special Cases Concerning the Settlement of Traffic Accidents, or Article 5-3 of the Act on the Aggravated Punishment, etc. of Specific Crimes;

3. Where he commits any illicit act in connection with the affairs of the instructor; and

4. Where he fails to complete the training course as prescribed in Article 71-7, without any justifiable reason.

(5) The school superintendent of a specialized school shall not have any person other than an instructor teach the academic subjects or skills on the driving of motor vehicles.

Article 71-6 (Skill Measurement)

(1) The Commissioner of the Local Police Agency may have the school superintendent of a specialized school, conduct the test and measurement on whether the trainees of the specialized school have the driving skill or driving ability on the road as prescribed in Article 71 (1) 2 and (2) 1 (hereinafter referred to as

“kill meaurement”), under the condition a precribed by the Presidential Decree.

(2) The school superintendent of a specialized school shall have a skill measurement personnel conduct the skill measurement only for those who have completed the curricula and skill training on the driving of motor vehicles, under the conditions as prescribed by the Ordinance of the Ministry of Home Affairs.

(3) The school superintendent of a specialized school shall not have a person other than the skill measurement personnel who conduct the skill measurement.

(4) The skill measurement personnel shall attest in writing for a person who has passed the skill measurement conducted by him and the fact that the person has passed the skill measurement, under the conditions as prescribed by the Ordinance of the Ministry of Home Affairs.

(5) The school superintendent of a specialized school shall deliver a certificate for a course completed, or a diploma, depending on the category of skill measurement, to a person for whom the skill measurement personnel has attested in writing the fact of a pass under paragraph (4), under the conditions as prescribed by the Ordinance of the Ministry of Home Affairs.

Article 71-6

Article 71-7 (Training and Education for Employees)

The school superintendent, deputy school superintendent, skill measurement personnel and instructors of a specialized school shall complete the training course necessary for carrying out the affairs of the specialized school, under the conditions as prescribed by the Presidential Decree.

Article 71-8 (Report and Inspection)

(1) The Commissioner of the Local Police Agency shall guide and supervise the specialized schools for the sound fostering and development thereof.

(2) If it is deemed necessary for the guideline and supervision of a specialized school, the Commissioner of the Local Police Agency may have the founder or school superintendent of the school, report matters concerning the facilities, equipment and education, or have any policeman enter and depart the facilities to inspect such facilities, equipment, books and other documents.

(3) Any policeman who enters and exits and completes an inspection under paragraph (2), shall carry with him a certificate indicating his competence, and show it to the related person upon demand.

Article 71-9 (Direction for Correction, etc.)

(1) If a specialized school does not conform to the criteria for designation as prescribed in Article 71-2 (1), the Commissioner of the Local Police Agency may order the founder or school superintendent of the specialized school to take necessary measures.

(2) If it is deemed necessary for the guidance and supervision, etc. of a specialized school, the Commissioner of the Local Police Agency may advise on necessary direction to the founder or school superintendent with respect to the affairs thereof.

Article 71-10 (Cancellation, etc. of Designation)

(1) The Commissioner of the Local Police Agency shall cancel the designation of a specialized school in the following cases:

1. Where the specialized school does not conform to the criteria for designation as prescribed in Article 71-2 (1);

2. Where the founder or school superintendent fails to obtain the approval, in contravention of the provisions of Article 71-2 (3);

3. Where the school superintendent delivers a certificate for course completed or a diploma to a person who fails to pass the skill test, in contravention of the provisions of Article 71-6 (5);

4. Where the school superintendent conducts the skill measurement during the period in which it is suspended under paragraph (2); and

5. Where the registration of the driver training becomes cancelled under the Act on the Establishment and Operation of Private Teaching Institutes.

(2) The Commissioner of the Local Police Agency may cancel the designation of a specialized school in conformity with such criteria as determined by the Ordinance of the Ministry of Home Affairs, or suspend the skill measurement as prescribed in Article 71-6 (1) with a period fixed to a limit of one year, in the following cases:

1. Where the school superintendent violates the provisions of Article 71-5 (5) or 71-6 (3);

2. Where the school superintendent has the skill measurement conducted by those who have not completed the academic subjects and skill training on the driving of motor vehicles, in contravention of the provisions of Article 71-6 (2);

3. Where a skill

measurement personnel has falsely attested the fact of passing the skill measurement test, in contravention of the provisions of Article 71-6 (4);

4. Where the school superintendent, deputy school superintendent, skill measurement personnel, or instructor fails to complete the training course as prescribed in Article 71-7;

5. Where the founder or school superintendent fails to produce a report or submit materials as prescribed in Article 71-8 (2), or makes a false report or submits false materials;

6. Where the founder, school superintendent or any employee of the specialized school refuses, interferes with, or evades the entry and inspection of the policeman concerned under Article 71-8 (2);

7. Where the founder or school superintendent fails to comply with the direction, etc. for correction as prescribed in Article 71-9; and

8. Where a person who graduated from a specialized school and holds the driver’s license, has caused traffic accidents in exceeding of such criteria as determined by the Presidential Decree, or violates such major traffic rules as prescribed by the Presidential Decree.

Article 71-10

Article 71-11 (Treatment as Public Official)

The school superintendents, deputy school superintendents and skill measurement personnel of the specialized schools shall be considered as public officials in application of the criminal provisions of the Criminal Act and other Acts, to the affairs of the skill measurement.

Article 71-12 (Expenses, etc. for Skill Measurement)

(1) The founder of a specialized school may collect the expenses needed for the skill measurement, etc. under the conditions as prescribed by the Presidential Decree, in addition to the tuition fee as prescribed in Article 15 of the Act on the Establishment and Operation of Private Teaching Institutes.

(2) If the designation is cancelled, or the skill measurement is suspended under Article 71-10, or it is impossible to render the training by any cause attributable to the specialized school, the founder of the specialized school shall return the tuition fee, etc. or transfer the trainees to other specialized schools depending on the intention of trainees, under the conditions as prescribed by the Presidential Decree.

(3) In the case where any trainee is transferred to another specialized school under paragraph (2), the training hours completed at the previous

specialized school shall be considered as those completed at the transferred specialized school.

Article 71-13 (Prohibition of Use of Similar Title)

No driver training school other than the specialized schools as prescribed by this Act, shall use the term “specialized school” or similar ones in their title.

Article 71-14 (Federation of Specialized Driver Training Schools)

(1) For the purpose of a sound fostering and development of the specialized schools and a promotion of the mutual co-operation and common interest among the specialized schools, the founders of specialized schools may establish the federation of specialized driver training schools (hereinafter referred to as “federation”).

(2) The federation shall be a juristic person.

(3) The articles of association of the federation shall include the following matters:

1. Object;

2. Title;

3. Seat of its principal office;

4. Matters concerning the board of directors and members;

5. Matters concerning the officers and employees;

6. Matters concerning projects;

7. Matters concerning the property and accounting; and

8. Matters concerning the modification of the articles of association.

(4) The articles of association as referred to in paragraph (3) shall be authorized by the Commissioner of the National Police Agency. This provision shall also apply in a case where the articles of association are modified.

(5) The federation shall carry out the following projects:

1. Research on the development of the specialized school system;

2. Development of the educational facilities and teaching materials of the specialized schools;

3. Research and development of the education conducted at the specialized schools and the method of skill measurement;

4. Projects of education and training for and improvement of welfare of the school superintendents, deputy school superintendents, skill measurement personnel and instructors of the specialized schools;

5. Matters entrusted by the Commissioner of the National Police Agency; and

6. Other projects necessary for attaining the object of the federation.

(6) The Commissioner of the National Police Agency shall supervise the federation, and may issue any order necessary for a sound operation of the federation, under the conditions as prescribed by the Presidential Decree.

(7) Except as provided in this Act, the provisions of the Civil Act concerning the corporate juristic person shall apply mutatis mutandis to the federation.

Article 72 (Exemption from Examination for Driver’s License)

Any person who falls under any of the following subparagraphs, shall be partially exempted from the examination for driver’s license under the conditions as may be prescribed by the Presidential Decree: <Amended by Act No. 4872, Jan. 5, 1995; Act No. 5405,

Aug. 30, 1997>

1. Person who has finished a mechanical course or subject on motor vehicles in a university, junior college or technical high school, and has learned in a course pertaining to motor vehicles during his school days;

2. Person who has passed an examination for technical qualification pertaining to the maintenance or inspection of motor vehicles under Article 4 of the National Technical Qualifications Act;

3. Person who possesses a driver’s license of motor vehicles delivered by a foreign competent organ;

4. Person who has practical experience as a driver of military motor vehicles for six months or more during military service;

5. Person who desires to obtain again the driver’s license, if his driver’s license was cancelled because of failure to undergo an aptitude test under Article 74 (1);

6. Person who again desires to obtain a different driver’s license from the previously obtained one; and

7. Person who holds a completion certificate of a specialized school as prescribed in Article 71-6 (5), and is within six months after he receives such certificate or within one year after he receives a diploma as prescribed in the said paragraph.

Article 72

Article 73 (Redelivery of Driver’s License)

If a person has lost his driver’s license or such license is worn out and has become unusable, he may be delivered a new one after reporting it to the Commissioner of the Local Police Agency under the conditions as may be prescribed by the Ordinance of the Ministry of Home Affairs. <Amended by Act No. 4369, May 31, 1991; Act No. 4872, Jan. 5, 1995>

Article 74 (Aptitude Test and Renewal of License)

(1) Any person holding the driver’s license (excluding the driver’s practice license) shall undergo the regular aptitude test conducted by the Commissioner of the Local Police Agency under the conditions as prescribed by the Presidential Decree, in the period as referred to in paragraph (2). <Amended by Act No. 4872, Jan. 5, 1995>

(2) The regular aptitude test period as referred to in paragraph (1) shall be as follows: <Newly Inserted by Act No. 4872, Jan. 5, 1995>

1. The first regular aptitude test period shall be within three months from the day on which five years expire, counting from the birthday of the person concerned in the year after he obtained his driver’s license; and

2. The regular aptitude test period other than that as referred to in subparagraph 1, shall be within three months from the day

on which five ears expire counting from the birthda of the person concerned in the year in which he obtains the driver’s license: Provided, That if the regular aptitude test is exempted under paragraph (5), it shall be within three months from the day on which seven years expire, counting from the birthday of the person concerned, in the year in which the regular aptitude test is exempted.

(3) Whenever the Commissioner of the Local Police Agency deems there is a sufficient reason to acknowledge that a driver of a motor vehicle, etc. (including those possessing an international driver’s license) falls under the provisions of Article 70 (1) 2 through 4, he may make the driver undergo an aptitude test from time to time under the conditions as may be prescribed by the Ordinance of the Ministry of Home Affairs. <Amended by Act No. 4369, May 31, 1991; Act No. 5405, Aug. 30, 1997>

(4) When the Commissioner of the Local Police Agency desires to conduct an aptitude test under paragraph (3), he shall inform in advance the person to be tested, of the date and the place of test, and other matters for taking the test. <Amended by Act No. 4369, May 31, 1991; Act N. 5405, Aug. 30, 1997>

(5) If no traffic accident has been caused, and no offense, as prescribed by the Presidential Decree is committed, in the period of five or seven years as referred to in subparagraphs of paragraph (2), the regular aptitude test shall be exempted. In this

case, the driver’s license shall be renewed and delivered within one year from the day following the completion date of regular aptitude test as referred to in paragraph (2). <Newly Inserted by Act No. 4872, Jan. 5, 1995; Act No. 5405, Aug. 30, 1997>

(6) The Commissioner of the Local Police Agency shall renew and deliver the driver’s license to those who have passed the aptitude test as referred to in paragraph (1), or who are exempted from the aptitude test under paragraph (5). In this case, the driver’s license renewed and delivered to those who are exempted from the aptitude test, may be made in any different color. <Newly Inserted by Act No. 4872, Jan. 5, 1995>

Article 75 (Modification of Matters Mentioned in License)

If it is required to modify any matter mentioned in a driver’s license, a report shall be made to the Commissioner of the Local Police Agency having jurisdiction over the domicile of the interested person, within fourteen days from the day on which the cause of modification has arisen, under the conditions as may be prescribed by the Ordinance of the Ministry of Home Affairs. <Amended by Act No. 4369, May 31, 1991; Act No. 4872, Jan. 5, 1995>

Article 76 (Provisional Driver’s License)

(1) When the Commissioner of the Local Police Agency has received a document as referred to in Articles 73 through 75 which was submitted by a person possessing a driver’s license, he shall deliver

the pson a provisional driv’s license und the conditions as may be prescribed by the Ordinance of the Ministry of Home Affairs: Provided, That in case where any application for the aptitude test or renewal and delivery of driver’s license under Article 74 has been submitted, matters prescribed by the Ordinance of the Ministry of Home Affairs shall be stated in the driver’s license which the applicant may possess, to thereby take the place of the delivery of provisional driver’s license. <Amended by Act No. 4369, May 31, 1991; Act No. 5405, Aug. 30, 1997>

(2) The provisional driver’s license as referred to in paragraph (1) shall have the same effect as the driver’s license during the effective period thereof.

Article 77 (Obligation to Carry and Present Driver’s License)

(1) Any driver who is driving a motor vehicle, etc., shall carry with himself his driver’s license (including the international driver’s license as prescribed in Article 80, and the construction machinery operator license as prescribed by the Construction Machinery Management Act; hereinafter referred to as “driver’s license, etc.”), or a certificate substituted for the driver’s license (referred to as a “provisional driver’s certificate” under Article 76, and “direction of attendance and notice for the payment of penalty” under Article 99, and a notice under Article 102 (2); hereinafter the same shall apply). <Amended by Act No. 4872, Jan. 5, 1995>

(2) When a driver, as referred to in paragraph (1) is requested, during operation,

by a policeman to present his driver’s license, etc. or a certificate substituted for it, he shall show it. <Amended by Act No. 4872, Jan. 5, 1995>

Article 78 (Cancellation and Suspension of License)

(1) When a person who possesses a driver’s license (excluding the driver’s practice license; hereinafter in this Article, the same shall apply), falls under any of the following subparagraphs, the Commissioner of the Local Police Agency may cancel the license or suspend the effect of the license within the limit of one year according to such criteria as may be determined by the Ordinance of the Ministry of Home Affairs: Provided, That if such driver falls under the following subparagraphs 1, 3, 6 or 7, his driver’s license shall be cancelled: <Amended by Act No. 4243, Aug. 1, 1990; Act No. 4369, May 31, 1991; Act No. 4421, Dec. 14, 1991; Act No. 4872, Jan. 5, 1995; Act No. 5405, Aug. 30, 1997>

1. When he falls under Article 70 (1) 2 through 4;

2. When he fails to undergo an aptitude test under Article 74 (1) and (3), or does not pass the aptitude test;

3. When it is revealed that he has obtained his driver’s license by a false or illicit means, or that he has been delivered his driver’s license or a certificate substituted for it during the period in which the effect of license is suspended;

4. When he has brought about a traffic accident on purpose or by negligence

during operation;

5. When he has committed a criminal offense by use of motor vehicles, etc.;

6. When he has stolen a vehicle, etc. from another person, or has taken it away by force;

7. When he applies for a driver’s license test as prescribed in Article 71 for the purpose of having another person granted, illicitly, the driver’s license;

8. When he drives a car in a drunken state in contravention of the provisions of Article 41, or though there is a considerable reason to deem that he is in a drunken state, he refuses to comply with any measurement by a policeman;

9. When he employs any violence against policemen, etc. and Si/Gun public officials who carry out their traffic control duties under this Act;

10. When he lends his driver’s license to another person to drive a vehicle; and

11. When he has violated the provisions of this Act, or an order issued or disposition taken for securing safe and smooth stream of traffic pursuant to this Act.

(2) If a person who is delivered a driver’s practice license, causes on purpose

or by negligence any traffic accident during the driving of a vehicle, or violates this Act or any order issued under this Act, the Commissioner of the Local Police Agency shall cancel the license, except in the case as prescribed by the Presidential Decree, such as in a case where it is not attributable to him, etc. <Newly Inserted by Act No. 4872, Jan. 5, 1995>

Article 79 (Return of License)

(1) When a person possessing a driver’s license falls under any of the following subparagraphs, he shall return his driver’s license to the Commissioner of the Local Police Agency having jurisdiction over his domicile within seven days after the occurrence of such causes: <Amended by Act No. 4369, May 31, 1991; Act No. 4872, Jan. 5, 1995>

1. When his driver’s license is cancelled;

2. When he has found his lost driver’s license after delivery of a new one; and

3. When a person holding the driver’s practice license has obtained the first or second-class ordinary license.

(2) When the Commissioner of the Local Police Agency has suspended the effect of a driver’s license, he shall make the person possessing the license return, and after keeping it in custody, shall return it to the person immediately after the expiration of the suspension period. <Amended by Act No. 4369, May 31, 1991>

Article 79

CHAPTER Ⅷ INTERNATIONAL DRIVER’S LICENSE

Article 80 (Driving of Motor Vehicles, etc. with International Driver’s License)

(1) Notwithstanding the provisions of Article 68 (1), a person who possesses a driver’s license issued in a foreign country (hereinafter referred to as “international driver’s license”) pursuant to the provisions of the Agreement relating to the Road Traffic (hereinafter referred to as “international agreement”), may be permitted to drive a motor vehicle, etc. in Korea with such a license only for one year after the day of his entry. In this case, the kind of vehicle which he may drive, shall be limited to that mentioned in such international driver’s license.

(2) The provisions of paragraph (1) shall not be applicable to the driving of a motor vehicle for such business as prescribed by the Automobile Transport Business Act.

Article 81 (Prohibition of Driving Motor Vehicles, etc.)

(1) When a person who drives a motor vehicle, etc. in the country with an international driver’s license under Article 80, falls under any of the following subparagraphs, the Commissioner of the Local Police Agency having jurisdiction over the driver’s domicile may prohibit the driving of a motor vehicle, etc. with

suc international driver’s license witin te limit not exceeding one year according to the criteria as provided by the Ordinance of the Ministry of Home Affairs: <Amended by Act No. 4369, May 31, 1991; Act No. 5405, Aug. 30, 1997>

1. When he did not undergo the aptitude test under Article 74 (3), or he did not pass such test;

2. When he has caused a traffic accident on purpose or by negligence during operation; and

3. When he has violated the provisions of this Act or an order issued or disposition taken under this Act relating to the driving of motor vehicles, etc.

(2) Any person who is prohibited from driving motor vehicles, etc. under paragraph (1), shall promptly present his international driver’s license to the Commissioner of the Local Police Agency who has ordered such prohibition. <Amended by Act No. 4369, May 31, 1991>

(3) When the period of prohibition as provided for in paragraph (1) has terminated, or the person who is subject to the disposition of prohibition, is to leave Korea in such period, the Commissioner of the Local Police Agency shall, upon his request, return to him the international driver’s license under his custody. <Amended by Act No. 4369, May 31, 1991>

Article 82 (Delivery, etc. of International Driver’s License)

Article 82

(1) When a person who has obtained a driver’s license under Article 68, desires to get an international driver’s license under an international agreement in order to drive a vehicle in a foreign country, he shall submit an application therefor to the Commissioner of the Local Police Agency. <Amended by Act No. 4369, May 31, 1991>

(2) The term of validity of an international driver’s license under paragraph (1) shall be one year from the day of delivery.

(3) When a domestic driver’s license of a person who has obtained an international license as provided in paragraph (1), is invalidated or cancelled, the latter is also invalidated.

(4) When a domestic driver’s license of a person who has obtained an international license as provided in paragraph (1), is suspended, the latter is also suspended during the period of the former’s suspension.

(5) Necessary matters concerning the delivery of an international driver’s license under paragraph (1) shall be determined by the Ordinance of the Ministry of Home Affairs.

CHAPTER Ⅸ ROAD TRAFFIC SAFETY ASSOCIATION

Article 83 (Establishment of Road Traffic Safety Association)

Article 83

(1) For the purpose of contributing to prevent of traffic dangers and obstacles on the roads, by establishing traffic order and improving traffic safety through an enlightenment for, education on, and technical development for, the traffic safety, the Road Traffic Safety Association (hereinafter referred to as the “Association”) shall be established.

(2) The Association shall be a juristic person.

(3) Necessary matters pertaining to the establishment and registration of the Association shall be determined by the Presidential Decree.

Article 84 (Establishment of Branches, etc.)

The Association may establish branches or substations, research institutes and educational institutions according to the provisions of its articles of Association. <Amended by Act No. 4243, Aug. 1, 1990; Act No. 4872, Jan. 5, 1995>

Article 85 (Articles of Association)

(1) The articles of Association shall include the matters enumerated in the following subparagraphs:

1. Purpose;

2. Title;

3. Seat of the principal office;

4. Matters concerning business;

5. Matters concerning the board of directors;

6. Matters concerning executive officers and staff;

7. Matters concerning property and accounts;

8. Matters concerning the fund;

9. Matters concerning the public notification; and

10. Matters concerning the modification of the articles of Association.

(2) If the Association desires to modify the articles of Association, it shall obtain the authorization of the Commissioner of the National Police Agency. <Amended by Act No. 4369, May 31, 1991>

Article 86 (Activities)

The Association shall carry out the activities enumerated in the following subparagraphs: <Amended by Act No. 4243, Aug. 1, 1990; Act No. 4872, Jan. 5, 1995>

1. Examination and research on countermeasures for the traffic safety;

2. Research, development, dissemination and technical service of the traffic

safety techniques;

3. Enlightenment and publicity of the traffic safety thought;

4. Education for the traffic safety and safety driving managers;

5. Study on and development for a traffic signal apparatus and safety marks;

6. Collection, publication and distribution of materials relating to the traffic safety;

7. Recommendation on problems in the application of Acts and subordinate statutes relating to the traffic;

8. Inducement of foreign technology pertaining to the traffic safety and

international co-operation with organizations related to the traffic safety;

9. Technical assistance pertaining to administrative affairs of the traffic safety, and assistance in education and training of public officials related to the traffic administration;

10. Activities relating to the traffic safety, which are entrusted by the State or local governments;

Article 86

11. Projects incidental to activities as referred to in subparagraphs 1 through 10; and

12. Other activities necessary for accomplishing the purpose of the Association.

Article 87 (Executive Officers)

(1) There shall be five or less directors (including one chief director) and one auditor in the Association.

(2) The chief director and the auditor shall be appointed and removed by the Commissioner of the Local Police Agency, and the directors shall be appointed and removed by the chief director, with the approval of the Commissioner of the Local Police Agency. <Amended by Act No. 4369, May 31, 1991>

(3) The tenure of chief director, directors and the auditor shall be two years. <Amended by Act No. 5405, Aug. 30, 1997>

Article 88 (Functions of Executive Officers)

(1) The chief director shall represent the Association, and exercise general control over the affairs of the Association.

(2) The auditor shall audit and supervise the accounts and activities of the Association.

Article 89 (Disqualification of Executive Officers)

No person who falls under any of the following subparagraphs, shall be an executive officer of the Association:

1. Person who has been declared incompetent, quasi-incompetent or bankrupt by the court, and has not been remitted;

2. Person who has been sentenced to imprisonment without prison labor or a more severe punishment, and for whom two years have not yet elapsed after completion of the sentence or determination of non-execution of such sentence;

3. Person who has been granted a suspended sentence of imprisonment without prison labor or a more severe punishment, and for whom one year has not yet elapsed at the expiration of the period of the suspended sentence;

4. Person who is on a withheld sentence after having been sentenced to imprisonment without prison labor or a more severe punishment; and

5. Person who is disqualified or whose qualification is suspended by a Act or judgment.

Article 90 (Board of Directors)

(1) In order to decide important matters of the Association, the board of directors shall be established in the Association.

(2) The board of directors shall be composed of directors including the chief director.

Article 90

(3) The chief director shall convene the board of directors, and preside over it.

(4) The board of directors shall pass a resolution with attendance of a majority of all the directors, and with concurrence of a majority of directors present.

(5) The auditor may give his opinion before the board of directors.

Article 91 (Staff)

The staff of the Association shall be nominated and dismissed by the chief director according to the provisions of the articles of Association.

Article 92 (Fund)

(1) In order to cover the expenses required for the operation and activities of the Association, the fund shall be established in the Association.

(2) The fund shall be composed of the following sources of revenue:

1. The subsidy of the Government and a local government;

2. The contribution of juristic persons, organizations or individuals; and

3. The allotted

charges of those who have obtaine the river’s licenses of motor vehicles, owners of motor vehicles for private use, those who carry on the motor vehicle third party liability insurance business under the Guarantee of Automobile Accident Compensation Act, administrations other than the road management administration, as provided for in the Toll Road Act, the Korea Highway Corporation, and other persons who are engaged in a business related to the road traffic, and designated by the Presidential Decree.

(3) The method and proportion of allotment of the charges as prescribed in paragraph (2) 3, and other necessary matters concerning the allotted charges shall be determined by the Presidential Decree.

Article 93 (Free Loan of Common Property)

Whenever it is required for facilities and operation of the Association, the local government may gratuitously lend a common property to the Association.

Article 94 (Business Year)

The business year of the Association shall conform to the fiscal year of the Government.

Article 95 (Approval of Business Program)

The Association shall prepare in advance every business year a operational plan to be approved by the Commissioner of the National Police

Article 96 (Presentation of Closing Accounts)

The Association shall prepare every business year, closing accounts of revenue and expenditure, and present it to the Commissioner of the National Police Agency by the end of February of the following year, after being audited by a certified public accountant as designated by the Commissioner of the National Police Agency. <Amended by Act No. 4369, May 31, 1991>

Article 97 (Supervision)

The Commissioner of the Local Police Agency may supervise the Association and issue an order necessary for accomplishing the purpose for which the Association is established. <Amended by Act No. 4369, May 31, 1991>

Article 98 (Application of Civil Act)

Matters, except as provided in this Act for the association shall apply mutatis mutandis to the provisions of the Civil Act relating to the incorporated foundation.

CHAPTER Ⅹ SUPPLEMENTARY PROVISIONS

Article 99 (Custody of Driver’s License)

(1) If a driver of

a motor vehicle, etc. causes any traffic accident or he is deemed to be subject to a cancellation or suspension of the driver’s license as prescribed in Article 78, the policeman shall deliver him on the spot a notice for the payment or summons as prescribed in Article 119, and may demand him to present the driver’s license, etc. and keep it in custody. In this case, there shall be mentioned on such notice for the payment or summons the fact that the driver’s license, etc. is kept. <Amended by Act No. 4872, Jan. 5, 1995>

(2) The summon or notice for the payment as referred to in paragraph (1) shall have the same effect as the driver’s license (excluding the driver’s practice license) until the day fixed for the attendance or payment of penalty. <Amended by Act No. 4872, Jan. 5, 1995>

Article 100 (Fee)

Any person who desires to make an application for the examination for driver’s license (including the skill measurement of a specialized school), delivery, etc. of driver’s licenses, designation, certification, permission, aptitude test or to obtain various certification related to the traffic and driver’s license in accordance with this Act, and any person who desires to apply for an examination for qualification of skill evaluator or instructor, shall pay the fee under the conditions as prescribed by the Ordinance of the Ministry of Home Affairs. <Amended by Act No. 5296, Mar. 7, 1997>

Article 100

Article 101 (Suspension of Use of Motor Vehicles)

(1) If a driver or a motor vehicle (excluding emergency motor vehicles; hereinafter the same shall apply) falls under any of the following subparagraphs, the Commissioner of the Local Police Agency may order the user of such motor vehicle to suspend the use of it in a period as prescribed in the limit of six months (in a case where it is used directly for a grave offense, one year) and to return a certificate of motor vehicle registration, and may provisionally hold the registration number plate under the conditions as may be prescribed by the Ordinance of the Ministry of Home Affairs: Provided, That if it becomes apparent that the user of the motor vehicle has paid and exercised a considerable attention and supervision, the motor vehicle has been stolen or robbed, or it has caused an act unattributable to the user at the time of offense, such asforce majeure, etc., this provision shall not be applicable: <Amended by Act No. 4369, May 31, 1991; Act No. 4872, Jan. 5, 1995; Act No. 5405, Aug. 30, 1997>

1. When the driver has caused a vital traffic accident on purpose or by negligence;

2. When the driver has run away without taking a measure under Article 50 after causing a traffic accident;

3. When the motor vehicle has been used for a criminal offense or for an act contrary to the public peace and order;

Article 101

4. When the driver fails to install the operation recorder, or operates a vehicle with an operation recorder unusable due to any trouble, etc. installed, in contravention of the provisions of Article 38-2; and

5. When the road maintenance agency requests a disposition of motor vehicle use suspension under Article 54 (4) of the Road Act.

(2) The extent of the vital traffic accident as referred to in paragraph (1) 1, and that of the act contrary to the public peace and order as referred to in paragraph (1) 3, shall be determined by the Presidential Decree.

(3) No person shall drive the motor vehicle of which use is suspended under paragraph (1); Provided, That this shall not apply to the case as prescribed by the Ordinance of Ministry of Home Affairs. <Newly Inserted by Act No. 5405, Aug. 30, 1997>

Article 101-2 (Hearing)

In the event that the Commissioner of the Local Police Agency desires to revoke the designation of a specialized school under Article 71-10, he shall hold a public hearing.

Article 101-2 ~ 102

Article 102-2 (Control of Passing Exclusive Way and Unlawful Parking and Stopping by Public Officials of Si/Kun)

(1) If a driver violates the provisions of Articles 13-2 (3) and 28 through 30, any public official of the Si/Gun may deliver on the site a notice specifying a summary of the offense, the date, place, etc. at which he is to attend before the chief of the police station under the conditions as prescribed by the Ordinance of the Ministry of Home Affairs, demand him to present his driver’s license and keep it in custody. In this case, the notice shall have the same effect as the driver’s license up to the date of attendance. <Amended by Act No. 5405, Aug. 30, 1997>

(2) If a public official of Si/Gun delivers a notice under paragraph (1), he shall without delay notify the competent chief of police station of the fact accompanied by the driver’s license. <Amended by Act No. 5405, Aug. 30, 1997>

(3) The chief of the police station who has been notified under paragraph (2) shall confirm the act of violation. <Newly Inserted by Act No. 5405, Aug. 30, 1997>

(4) No public official of Si/Gun shall abuse his ex officio authority, deviating from the primary purpose, when he delivers a notice or takes measures under paragraph (1). <Newly Inserted by Act No. 5405, Aug. 30, 1997>

Article 102-2

Article 103 (Enactment of Traffic Safety Rules)

(1) The Commissioner of the National Police Agency shall enact and disseminate the traffic safety rules.

(2) The traffic safety rules as referred to in paragraph (1) shall include the following matters:

1. Provision of Acts and subordinate statutes relating to the safety of the road traffic;

2. Matters necessary for securing a safe and smooth traffic flow by preventing and removing any danger and obstacle to the traffic caused on the road; and

3. Knowledge necessary for the handling method and safe driving of motor vehicles, etc., in addition to the matters as referred to in subparagraphs 1 and 2.

Article 103-2 (Supply of Traffic Condition Reports)

The Commissioner of the Local Police Agency shall collect and analyze reports necessary for ensuring safe and smooth traffic flow, and supply without delay the result to general people.

Article 104 (Delegation and Entrustment of Authority)

(1) TheMayor, etc. may delegate or entrust part of his authority vested under this Act to the Commissioner of the Local Police Agency or the chief of the police station, under the conditions as prescribed by the Presidential Decree. <Newly Inserted by Act No. 4518, Dec. 8, 1992; Act No. 4872, Jan. 5, 1995; Act No. 5405, Aug. 30, 1997>

(2) The Special Metropolitan City Mayor or Metropolitan City Mayor may delegate part of his authority vested under this Act to the head of Gun/Gu in the jurisdictional area, under the conditions as prescribed by the Presidential Decree. <Newly Inserted by Act No. 5405, Aug. 30, 1997>

CHAPTER XI PENAL PROVISIONS

Article 106 (Penal Provisions)

Any person who has not taken a measure at the time of occurrence of a traffic accident under Article 50 (1), shall be punished by imprisonment for not more than five years or a fine not exceeding three million won. <Amended by Act No. 4243, Aug. 1, 1990>

Article 107 (Penal Provisions)

(1) Any person who has operated without permission the signal apparatus, or who has dismantled, removed or destroyed a signal apparatus or safety mark, in contravention of the provisions of Article 63 (1), shall be punished by imprisonment for not more than three years or a fine not exceeding three million won. <Amended by Act No. 4243, Aug. 1, 1990>

(2) Any person who has caused a traffic danger on the road by an act as referred to in paragraph (1), shall be punished by imprisonment for not more than five years or a fine not exceeding three million won. <Amended by Act No. 4243, Aug. 1, 1990>

Article 107-2 (Penal Provisions)

Any person who falls

1. Person who drives a motor vehicle, etc. in a drunken condition in contravention of the provisions of Article 41 (1);

2. Person who has a considerable reason to be recognized in a drunken condition and fails to comply with a measurement of a policeman under Article 41 (2);

3. Person who delivers a completion certificate or diploma as prescribed in Article 71-6 (5), without having a specialized school as prescribed in Article 71-2 (1) designated;

4. Person who has the specialized school as prescribed in Article 71-2 (1) designated by a false or any other illicit way; and

5. Person who conducts the skill measurement in the period in which the skill measurement is suspended under Article 71-10 (2).

Article 108 (Penal Provisions)

When the driver

of a vehicle has damaged o destoyed a building o othe property of another person, by failure to take the necessary care for his occupation or a grave negligence, he shall be punished by imprisonment without prison labor for not more than two years or a fine not exceeding two million won. <Amended by Act No. 4872, Jan. 5, 1995>

Article 109 (Penal Provisions)

Any person who falls under any of the following subparagraphs, shall be punished by an imprisonment for not more than one year or a fine not exceeding one million won: <Amended by Act No. 4243, Aug. 1, 1990; Act No. 4872, Jan. 5, 1995; Act No. 5405, Aug. 30, 1997>

1. A person who has driven a motor vehicle without obtaining a driver’s license (excluding a license for motor bicycle; hereinafter the same shall apply in this Article) under Article 68 (including in the case where the validity of the driver’s license is suspended) in contravention of the provisions of Article 40 (1), or without obtaining an international driver’s license under Article 80 (including in the cases where the driving is prohibited and the term of validity is over);

2. A person who has violated the provisions of Article 63 (2);

3. A person who violates the provisions of Article 40 (2) or (3);

4. An employer,

etc. who has made a motor vehicle to be driven by a person possessing no driver’s license (including a person, the validity of whose driver’s license is suspended, and a person who is not permitted to carry out a driving practice according to Article 40 (2)) in contravention of the provisions of Article 52 (2);

5. A person who has obtained a driver’s license, or has a driver’s license or certificate substituted for such license, delivered by a false or illicit means; and

6. A person who violates the provisions of Article 71-13.

7. A person who violates the provisions of Article 101 (3).

Article 110 (Penal Provisions)

Any person who falls under any of the following subparagraphs, shall be punished by imprisonment for not more than six months, or a fine not exceeding five hundred thousand won, or a penal detention: <Amended by Act No. 4243, Aug. 1, 1990; Act No. 4518, Dec. 8, 1992; Act No. 4872, Jan. 5, 1995>

1. Person who has violated the provisions of Article 37, 38-2, 42-2 or 51;

2. Person who has disobeyed, refused or obstructed the demand, measure or order of a policeman under Article 38, 43 or 54;

3. Person who has violated the provisions of Article 45 (1) or (4);

4. Person who has neglected a duty of supervision concerning safe driving under Article 46;

5. Person who has installed, without permission a signal apparatus, safety mark or other similar structure in contravention of the provisions of Article 63 (1); and

6. Person who has driven any motor vehicle in contravention of the conditions as provided in Article 68 (3) or (4).

Article 111 (Penal Provisions)

Any person who falls under any of the following subparagraphs, shall be punished by a fine not exceeding three hundred thousand won or a penal detention: <Amended by Act No. 4872, Jan. 5, 1995>

1. A person who has violated the provisions of Article 39 or 42;

2. A person who has driven a motor bicycle without obtaining a license for a motor bicycle under Article 68 in contravention of the provisions of Article 40;

3. A person who has not made a report under Article 50 (2);

4. An employer who has ordered a person possessing no license for a motor bicycle to drive it in contravention of the provisions of Article 52 (2);

Article 111

5. A person who has violated the provisions of Article 58;

6. A person who fails to provide a report as prescribed in Article 64 (1), or to install a signal apparatus or safety mark as referred to in paragraph (2), or to restore the signal apparatus or safety marks to the original state, in contravention of the provisions of paragraph (3); and

7. A person who has violated an order of the chief of the police station under Article 66 (1).

Article 112 (Penal Provisions)

Any person who has violated the provisions of Article 47 or 77 (2), shall be punished by a fine not exceeding two hundred thousand won, or a penal detention. <Amended by Act No. 4872, Jan. 5, 1995; Act No. 5405, Aug. 30, 1997>

Article 113 (Penal Provisions)

Any person who falls under any of the following subparagraphs, shall be punished by a fine not exceeding one hundred thousand won, a penal detention or a minor fine: <Amended by Act No. 4243, Aug. 1, 1990; Act No. 4369, May 31, 1991; Act No. 4872, Jan. 5, 1995; Act No. 5405, Aug. 30, 1997>

1. A driver of a vehicle or horse who has violated the provisions of Article 5, 12 (1) through (3) and (5), 13 (2) through (4), 13-2 (3) (including the case applied mutatis mutandis

in Article 56-2 (2)), 14, 15 (3), 16 through 19-2, 21, 22 through 24-2, 28, 29, 32, 33 (1), 34 (1) and (3), 35 (1) through (4), 44, 48, 48-2 (1) and (3), 48-3, 48-4 (1), 48-5, 49, 57, or 77 (1);

2. A driver of a vehicle who has violated a prohibition, restriction or measure under Article 6 (1) through (3) or 7;

3. A person who has violated the provisions of Article 27, 27-2, 30 or 36 or an order under Article 31 (1);

4. A person who has violated a restriction imposed by the Commissioner of the Local Police Agency under Article 35 (5);

5. A person who has violated the provisions of Articles 20 through 20-3, 25 (4) and (5), 56 (1) and (2), 59 through 61 or 62 (1);

6. A driver who has violated the rules to be observed on the expressway or motor exclusive road under Article 62 (2); and

7. A person who has not undergone the aptitude test in violation of the provisions of Article 74 (1) or (3), or a person who has not returned his driver’s license in violation of the provisions of Article 79 (1).

Article 114 (Penal Provisions)

Any person who falls

under any of the following subparagraphs, shall be punished by a fine not exceeding one hundred thousand won, a penal detention, or a minor fine: <Amended by Act No. 4872, Jan. 5, 1995>

1. A pedestrian who has violated the provisions of Article 5, 8 (1) and (2) or 10 (2) through (5);

2. A pedestrian who has violated a prohibition, restriction or measure under Article 6 (1) through (3) or 7;

3. A leader of a procession or pedestrian who has violated the provisions of Article 9 (1);

4. A person who has neglected the protection of an infant, in contravention of the provisions of Article 11 (1);

5. A user of a motor vehicle who has violated the provisions of Article 45 (2); and

6. A guardian who has violated the provisions of Article 63 (3).

Article 115 (Concurrent Imposition of Punishment)

Any person who has committed any offense as provided for in this Chapter, may be punished concurrently by a fine or a minor fine and penal detention, in consideration of the extenuating circumstances.

Article 115-2 (Fine for Negligence)

Article 115 ~ 115-2

(1) Any person who falls under any of the following subparagraphs, shall be punished by a fine for negligence not exceeding two million won: <Newly Inserted by Act No. 4872, Jan. 5, 1995>

1. A person who violates the provisions of Article 71-7;

2. A person who refuses, interferes with, or evades an entry and departure or inspection of a related police official under Article 71-8 (2); and

3. A person who fails to comply with any direction, etc. for correction as prescribed in Article 71-9.

(2) Any person who fails to report on a change in matters mentioned in the driver’s license, in contravention of the provisions of Article 75, shall be punished by a fine for negligence not exceeding one hundred thousand won. <Newly Inserted by Act No. 4872, Jan. 5, 1995>

(3) If it is proved, by means of photo, video tape or other picture recording media, that any motor vehicle violates the provisions of Article 5, 13-2 (3) (including the case applied mutatis mutandis in Article 56-2 (2)), 15 (3) or 28 through 30, in case where the notice under Article 102-2 (1) may not be delivered because the driver who has violated said provisions is not confirmed (limited to the violation of the provisions of Article 13-2 (3) or 28 through 30) or the disposition of notification under Article 118 may not be done (limited to the

violation of the provisions of Article 13-2 (3) applied mutatis mutandis under Article 5, 15 (3) or 56-2 (2)), the employer, etc. as referred to in Article 52 (1) shall be punished by a fine for negligence not exceeding one hundred thousand won: Provided, That this shall not apply in case where it falls under any of the following subparagraphs: <Amended by Act No. 5405, Aug. 30, 1997>

1. Where the vehicle is stolen, or there is any inevitable reason;

2. Where the driver is punished under Article 113 for the offense concerned (including the case where he is subject to a disposition of notice on the penalty under Article 118);

3. Where the driver who has violated becomes clear as a result of hearing of opinion under paragraph (5); and

4. Where the vehicle is leased by a motor vehicle lease businessman as prescribed by the Automobile Transport Business Act, and it is obvious that only the vehicle is leased.

(4) The fine for negligence under paragraphs (1) through (3) shall be imposed and collected by the persons of the following paragraphs: <Amended by Act No. 5405, Aug. 30, 1997>

1. Fine for negligence under paragraphs (1), (2), and (3) (limited to the violation of the provisions of Article 13-2 (3) applied

mutatis mutandis under Article 5, 15 (3) or 56-2 (2)): The Commissioner of the Local Police Agency; and

2. Fine for negligence under paragragraph (3) (limited to the violation of the provisions of Articles 13-2 (3) and 28 through 30): The Mayor, etc.

(5) Where the fine for negligence is imposed under paragraph (3), a period of not less than 10 days shall be specified so as to provide the person subject to the disposition of fine for negligence with an opportunity to state his opinion. In this case, it shall be presumed that there is no opinion if any oral or written statement of opinion is absent within that period. <Newly Inserted by Act No. 5405, Aug. 30, 1997>

(6) Where the driver who has violated became clear as a result of statement of opinion under paragraph (5), the Commissioner of the Local Police Agency or the Mayor, etc. shall notify the competent chief of the police station of such fact accompanied with materials verifying it. <Newly Inserted by Act No. 5405, Aug. 30, 1997>

(7) Any person who is dissatisfied with a disposition of fine for negligence as provided in paragraphs (1) through (3), may raise an objection against the Commissioner of the Local Police Agency or the Mayor, etc. within thirty days after he is notified of such disposition. <Amended by Act No. 4872, Jan. 5, 1995; Act No. 5405, Aug. 30, 1997>

Article 115-2

(8) If a person who is subject to a disposition of fine for negligence under paragraphs (1) through (3), makes an objection as provided in paragraph (7), the Commissioner of the Local Police Agency or the Mayor, etc. shall notify it without delay to the competent court, which shall, upon receiving the notification, bring the case of fine for negligence to a trial under the Non-Contentious Case Litigation Procedure Act. <Amended by Act No. 4872, Jan. 5, 1995; Act No. 5405, Aug. 30, 1997>

(9) If no objection is raised, and no fine for negligence is paid, in the period as referred to in paragraph (7), it shall be collected according to the examples of disposition of the national or local taxes in arrears. <Amended by Act No. 4872, Jan. 5, 1995; Act N0. 5405, Aug. 30, 1997>

Article 116 (Joint Penal Provisions)

When a representative of a juristic person or an agent, servant or any other employee of a juristic person or an individual has violated the provisions of this Act with respect to the business of such juristic person or individual, this shall also be punished by a fine or a minor fine as prescribed in the respective Articles, in addition to the punishment of the offender.

CHAPTER XII SPECIAL CASES RELATING TO A

Article 116

CT OF OFFENSE

Article 117 (Common Provisions)

(1) For the purpose of this Chapter, the term “act of offense” means the contravention falling under the offenses as referred to in each subparagraph of Article 113 or 114, and the concrete scope thereof shall be determined by the Presidential Decree.

(2) The term “offender” in this Chapter means a person who has done an act of offense, but does not fall under any of the following subparagraphs:

1. Driver of a motor vehicle, etc. who has not presented his driver’s license at the time of the offensive act;

2. Person who has caused a traffic accident by an act of offense excluding those who are not punished for a crime of bodily injury caused by negligence in the conduct of business or gross negligence, or offense as provided for in Article 108 of this Act, under Articles 3 (2) and 4 of the Act on Special Cases concerning the Settlement of Traffic Accidents; and

3. Person possessing an international driver’s license under Article 80.

(3) The term “penalty” used in this Chapter means the money to be paid by an

offeder to the Natioal Treasury pursuat to a disposition of notification under Article 118, and the amount of such penalty shall be determined by the Presidential Decree, depending on the nature and area of offense, and type of vehicle.

Article 118 (Disposition of Notification)

The chief of the police station may notify the person who is deemed to be the offender, of the payment of the penalty by means of a written notice specifying the reasons therefor: Provided, That this shall not apply for a person who falls under any of the following subparagraphs:

1. Person whose name and domicile are uncertain;

2. Person who might be considered to run away; and

3. Person who has refused to receive a written notice concerning the payment of the penalty.

Article 119 (Payment of Penalty)

(1) Any person who has received a written notice of penalty payment under Article 118, shall pay it, within ten days, to the Bank of National Treasury or its branch or local agent, or a post office as designated by the Commissioner of the National Police Agency: Provided, That if it is impossible to pay the penalty in the prescribed period owing to natural disasters or other inevitable reasons, he shall pay it within five days from the day on which such cause disappeared. <Amended by

(2) Any person who fails to pay the penalty during the period of payment as referred to in paragraph (1), shall pay the amount added by 20/100 to the notified penalty within twenty days from the day following the expiration date for the payment. <Newly Inserted by Act No. 4421, Dec. 14, 1991>

(3) Any person who has paid a penalty pursuant to the provisions of paragraph (1) or (2), shall not be punished again for the same act of offense. <Amended by Act No. 4421, Dec. 14, 1991>

Article 120 (Measure against Person Failing to Observe Disposition of Notice)

The chief of a police station shall remit without delay any person who falls under any of the following subparagraphs, to the summary trial: <Amended by Act No. 4421, Dec. 14, 1991>

1. Person who falls under any of the subparagraphs of Article 118; and

2. Person who has not paid the penalty in a prescribed time limit of payment under Article 119 (2).

Article 121 (Prohibition of Official Oppression)

In making a disposition of notice pursuant to the provisions of this Chapter,

the policeman responsible for the control of traffic shall not abuse imprudently his official authority contrary to the original purpose.

ADDENDA

Article 1 (Enforcement Date)

This Act shall enter into force six months after the date of its promulgation: Provided, That the portion of the provisions of Article 113, which provides for non-punishment against such failure to produce a report on modification of matters mentioned in the driver’s license, as punished pursuant to the provisions of Articles 62 and 79 of the previous Road Traffic Act, shall enter into force on the day this Act is promulgated.

Article 2 (Transitional Measures concerning Previous License, etc.)

Any person who obtained a license or permission, or made a report pursuant to the previous Act before the enforcement of this Act, shall be taken to have obtained such license or permission or made such report.

Article 3 (Transitional Measures concerning Previous Dispositions, etc.)

The orders, measures or dispositions which have been taken pursuant to the previous provisions before the enforcement of this Act, and which

are not contrary to this Act, shall be considered to have been taken under this Act. ·Article 4

(1) through (3) Omitted.

(4) In a case where the provisions of the previous Road Traffic Act are quoted in other Acts and subordinate statues, if there are Articles corresponding to them in this Act, such corresponding Articles of this Act shall be considered to be applied in lieu of them.

Article 3 (Examples of Application concerning Disposition of Fine for Negligence for Employer, etc.)

The amended provisions of Article 115-2 shall not be applicable to the employer, etc. of the driver of the motor vehicle who has violated the said provisions before this Act enters into force.

Article 4 (Transitional Measures concerning Tenures of Office of Chief Director and Directors of Association)

Tenures of office of the chief director and directors of the Association when this Act enters into force shall be dealt with according to the previous provisions applicable, notwithstanding the provisions of Article 87 (3).
