Article 1 (Purpose)

The purpose of this Act is to promote the efficiency of school education by providing the matters necessary for the management of health care and the environmental sanitation cleanup of a school, and by protecting and promoting the health of students and teaching staff.

Article 2 (Definition)

For the purpose of this Act, the term “physical checkup” means physical fitness test, constitutional fitness test, and physical aptitude test.

Article 3 (Health Facilities)

A founder and a manager of a school shall establish a health room, and furnish the facilities and appliances necessary for school health care as prescribed by the Presidential Decree.

Article 4 (Environmental Sanitation and Food Sanitation of School)

A head of a school shall maintain environmental sanitation and food sanitation appropriately, such as air pollution, ventilation, lighting, illumination, temperature and humidity of a school, and tableware and food materials, drinking water, water supply and drainage, toilets, disposal of sewage and garbage in a school building as prescribed by the Ordinance of the Ministry of Education.<Amended by Act No. 4268, Dec. 27, 1990>

Article 5 (Establishment of School Environmental Sanitation and Cleanup Zone)

(1) In order to achieve the purpose as referred to in Article 1, the education committee under the jurisdiction of the Seoul Special Metropolitan City, Metropolitan City, and Do (hereinafter referred to as “City/ Do”) shall designate the school environmental sanitation and the cleanup zone as prescribed by the Presidential Decree. In this case, the school environmental sanitation and cleanup zone shall not exceed 200 meters from the boundary line of a school. <Amended by Act No. 4349, Mar. 8, 1991>

(2) The authority

of the education committee of Ci/Do as referred to in the provisions of paragraph (1) may be delegated to the head of education district board or the educational superintendent of Si/Gun under the Presidential Decree. <Amended by Act No. 4349, Mar. 8, 1991>

Article 6 (Prohibited Activities, etc. in Cleanup Zone)

(1) No one shall conduct any activities or establish any facilities falling under any of the following subparagraphs, in the school environmental sanitation and clean up zone: Provided, That among the activities and facilities as referred to in subparagraphs 2, 4, 8, and 10 through 14 of Article 6 in the zone prescribed by the Presidential Decree, the activities and facilities which the person designated by a superintendent of the board of education in the education committee of City/Do or a superintendent of the board of education deems it harmless to study, school health and sanitation, shall be excluded: <Amended by Act No. 4349, Mar. 8, 1991>

1. Activities and facilities which are harmful to study and school health and sanitation by exceeding the allowed standard of pollutant discharge as provided in Article 14 of the Environmental Conservation Act;

2. A theater, a factory and a storing place of firearms and explosives, a factory and a storing place of compressed gas and liquid

gas;

3. A slaughter house, a crematorium;

4. A gathering place of waste;

5. A burial ground of waste, an incinerating place of waste, facilities for the terminal treatment of waste, or terminal treatment plant of night soil;

6. A place for disposal of dead animals, a chemical production factory;

7. A hospital for contagious diseases, an isolation ward for contagious diseases, an isolation building;

8. A sanatorium or a clinic for contagious diseases;

9. A livestock market;

10. A speciality restaurant, all types of entertainment restaurants, a bar;

11. A hotel, a motel, and an inn;

12. A resting place among public bath;

13. Gambling places, a billiard room, or a horse race track; and

to a decision on unconstitutionality by the Constitutional Court at April 26, 1997, the parts concerning a university, a teacher’s college, a college of education, a junior college, an Air and Correspondence College, an open college, a technical college, a kindergarten and an institute similar to that of a kindergarten under the provisions of Article 81 of the Education Act on the part of “a billiard room” as provided in paragraph (1) 13 of this Article, shall be deemed in violation by the Constitutional Act>

14. Other activities and facilities similar to those as referred to in subparagraphs 1 through 13, the activities and facilities harmful to public morals and customs among the activities and facilities prescribed by the Presidential Decree.

(2) The matters concerning the organization, function, and operation of the committee for school environmental sanitation and cleanup under paragraph (1) shall be prescribed by the Presidential Decree.

(3) The Seoul Special Metropolitan City Mayor, Metropolitan City Mayor and Do governor (hereinafter referred to as the “Mayor/Do governor”) shall take measures necessary for the prevention of activities and facilities as referred to in paragraph (1), if necessary, he may give an order to remove the facilities. <Amended by Act No. 4349, Mar. 8, 1991>

(4) The authority of the Mayor/Do governor as referred to in the provisions

Article 7 (Physical Examination)

(1) Head of a school shall conduct a physical examination of the students and the teaching staff every year: Provided, That the physical examination of the teaching staff may be substituted for a health examination under Article 29 of the Act on the Medical Insurance for Public Officials and Private School Teachers and Staff.

(2) The matters concerning the date, method, and procedure of the physical examination shall be prescribed by the Ordinance of the Ministry of Education. <Amended by Act No. 4268, Dec. 27, 1990>

Article 8 (Suspension of School Attendance)

According to the results of the physical examination under the provisions of Article 7, the head of school may suspend a school attendance of the students and the teaching staff who are infected or suspected to be infected, or likely to be infected with a contagious disease as prescribed by the Presidential Decree.

Article 9 (Health Care for Students)

The head of school shall take measures necessary for the improvement of growth and development, nutritional care, treatment and prevention, etc. of diseases.

Article 10 (Idem)

A head of elementary school shall inspect whether the students have taken all vaccinations or not, as referred to in Article 11 of the Prevention of Contagious Diseases Act, within 90 days after the students enter a school anew. <Amended by Act No. 5069, Dec. 29, 1995>

Article 11 (Idem)

(1) According to the results of the physical examination under the provisions of Article 7, the head of school shall take necessary measures for the students who are infected or likely to be infected with diseases in order to treat and prevent the diseases.

(2) In a case when it is necessary to take such measures as provided in subparagraph 1, the head of school may ask the director of a public clinic for cooperation, and the director of a public clinic shall not reject this request without any justifiable reason.

Article 13 (Health Care for Teaching Staff)

The head of school shall take measures necessary for the treatment of diseases and improvement, etc. of working conditions according to the results of a physical examination under the provisions of Article 7.

Article 14 (Prevention of Diseases)

A head of a supervisory office may give an order to close the school concerned, if he deems it necessary for the prevention of contagious diseases and school health, the head of school may close his school, if necessary.

Article 14-2 (Execution of Vaccinations against Contagious Diseases)

In executing a regular or extra vaccination to the students and the teaching staff concerned under the provisions of Articles 11 and 12 of the Prevention of Contagious Diseases Act, the Mayor/Do governor, or the head of Si/ Eup/Myeon may delegate to the school physician or the school nurse (this is restricted to those who have a nurse’s license) to execute a regular or extra vaccination. In this case, the school nurse shall not be applied to the provisions of Article 25 (1) of the Medical Service Act. <Amended by Act No. 4349, Mar. 8, 1991>

Article 13 ~ 14-2

Article 15 (School Physician, School Pharmacist and School Nurse)

The school physician (including a dentist and a herb doctor), the school pharmacist and the school nurse in charge of the health care of the students and the teaching staff shall be installed in a school as prescribed by the Presidential Decree. <Amended by Act No. 4349, Mar. 8, 1991>

Article 16 (Installation of Health Organizations, etc.)

The organizations and public officers necessary for the school health care shall be installed under the jurisdiction of the education committee of City/ Do and the educational superintendent of Si/Gun as prescribed by the Presidential Decree. <Amended by Act No. 4349, Mar. 8, 1991>

Article 17 (School Health Committee)

(1) The School Health Committee shall be installed in the Ministry of Education in order to deliberate on important policy about school health. <Amended by Act No. 4268, Dec. 27, 1990>

(2) The School Health Committee shall consist of not more than 15 members who have experience in school health.

(3) Other matters necessary for the operation of the School Health Committee shall be prescribed by the Presidential Decree.

Article 18 (Supplement of Expenses)

The government shall support the whole or parts of the expenses required for physical examinations as provided in Article 7 (1).

Article 19 (Penal Provisions)

A person who violates the provisions of Article 6 (1) shall be punished by imprisonment for not more than one year or to a fine not exceeding one million won.

Article 20 (Enforcement Decree)

The matters necessary for the enforcement of this Act shall be prescribed by the Presidential Decree.
