Article 1 (Purpose)

The purpose of this Act is to promote the efficiency of school education by providing the matters necessary for the management of health care and the environmental sanitation cleanup of a school, and by protecting and promoting the health of students and teaching staff.

Article 2 (Definition)

For the purpose of this Act, the term “physical checkup” means physical fitness test, constitutional fitness test, and physical strength test. <Amended by Act No. 5618, Dec. 31, 1998>

Article 3 (Health Facilities)

A founder and a manager of a school shall establish a health room, and furnish the facilities and appliances necessary for school health care as prescribed by the Presidential Decree. <Amended by Act No. 5618, Dec. 31,

Article 4 (Environmental Sanitation and Food Sanitation in School)

The head of a school shall, pursuant to the Ordinance of the Ministry of Education and Human Resources Development, maintain and protect appropriately environmental sanitation such as the control of ventilation, light, illumination, temperature and humidity, the installation and management of water supplies and drainages and rest rooms, and the prevention and disposal of polluted air, waste, noise and dust, and food sanitation such as the control of tableware, food and drinking water in a school building. <Amended by Act No. 6400, Jan. 29, 2001>▷

Article 5 (Establishment of School Environmental Sanitation and Cleanup Zone)

(1) In order to protect health, sanitation and environment related tostudy in a school, the Superintendent of the Office of Education shallestablish the school environmental sanitation and cleanup zone pursuant to the Presidential Decree. In this case, the school environmental sanitation and cleanup zone shall not exceed 200 meters from the boundaryline of a school. <Amended by Act No. 4349, Mar. 8, 1991; Act No. 5454, Dec. 13, 1997; Act No. 5618, Dec. 31, 1998>

(2) The authority of the Superintendent of the Office of Education as prescribed in paragraph (1) may be delegated to the head of a district office of education pursuant to the Presidential Decree. <Amended by Act No. 4349, Mar. 8, 1991; Act No. 5618, Dec. 31, 1998>

Article 6 (Prohibited Activities, etc. in Cleanup Zone)

(1) No one shall conduct any activities or establish any facilities falling under any of the following subparagraphs in the school environmental

sanitation and cleanup zone: Provided, That from among the activities and facilities as referred to in subparagraphs 2, 4, 8, and 10 through 14 in the zone prescribed by the Presidential Decree, the activities and facilities which Superintendent of the Office of Education or a person delegated by the Superintendent of the Office of Education deems harmless to study, health and sanitation in a school via the deliberation of the school environment and sanitation cleanup committee, shall be excluded: <Amended by Act No. 4349, Mar. 8, 1991; Act No. 5618, Dec. 31, 1998; Act No. 6716, Aug. 26, 2002; Act No. 7120, Jan. 29, 2004; Act No. 7170, Feb. 9, 2004>

1. Activities and facilities which are harmful to study and school healthand sanitation by exceeding the permissible discharge standards

under the Clean Air Conservation Act, the Malodor Prevention Act and the Water Quality Conservation Act or the control standards

under the Noise and Vibration Control Act;

2. A theater, a factory and a storing place of firearms and explosives, a factory and a storing place of high-pressure gas, natural gas and liquefied petroleum gas;

<The provisions of this subparagraph concerning ‘theater’ has losteffect on the schools provided in Article 2 of the Higher Education Act due to the decision of unconstitutionality by

the Constitutional Court on May 27, 2004>

3. A slaughter house and a crematorium;

4. A gathering place of waste;

5. Waste disposal facilities (excluding the waste disposal facilities installed and operated by medical institutions within the medical institutions for treating pathogenic wastes), wastewater terminal treatment facilities, livestock wastewater discharge facilities, livestock wastewater treatment facilities, and excreta treatment facilities;

6. A place in which dead livestock is treated, and facilities for the processing and treatment of skins of animals;

7. A hospital for contagious diseases, an isolation ward for contagious diseases, an isolation building;

8. A sanatorium or a clinic for contagious diseases;

9. A livestock market;

10. Business in which alcoholic liquors are sold mainly and to which an act of singing by a customer is permitted, and that in which the employment of an entertainer, the installation of entertainment facilities and an act of dancing by a customer other than the said act is permitted;

11. A hotel, a motel, and an inn;

12. A billiard room (cases of kindergartens as prescribed in subparagraph 2 of Article 2 of the Early Childhood Education Act and environment and sanitation cleanup zones of schools as prescribed in subparagraphs of Article 2 of the Higher Education Act shall be excluded);

13. A speculative act place and a horse race track; and

14. Other activities and facilities similar to those as referred to in subparagraphs 1 through 13, and those harmful to public morals andcustoms among the activities and facilities prescribed by the Presidential Decree.

(2) The matters concerning the organization, function, and operation of the school

environment and sanitation cleanup commitee under paragraph (1) shall be prescribed by the Presidential Decree.

(3) The Special Metropolitan City Mayor, a Metropolitan City Mayor

and a Do governor (hereinafter referred to as the “Mayor/Do governor”)

shall take measures necessary for the prevention of activities and facilities as referred to in paragraph (1), and if necessary, may give an order to remove the facilities. <Amended by Act No. 4349, Mar. 8, 1991; Act No. 5454, Dec. 13, 1997>

(4) The authority of the Mayor/Do governor as referred to in the provisions of paragraph (3) may be delegated to the head of a Si/Gun/

Gu (limited to the head of an autonomousGu; hereinafter the same

Article 7 (Physical Examination)

(1) The head of a

school shall conduct physical examination of thestudents and the teaching staff every year: Provided, That the physical examination of the teaching staff may be substituted for a health examination under Article 29 of the National Medical Insurance Act. <Amended by Act No. 5618, Dec. 31, 1998>

(2) The matters concerning the date, method, and procedure of the

physical examination shall be prescribed by the Ordinance of the Ministry of Education and Human Resources Development. <Amended by Act No. 4268, Dec. 27, 1990; Act No. 6400, Jan. 29, 2001>

Article 8 (Suspension of School Attendance)

According to the results of the physical examination under the provisions of Article 7, the head of a school may suspend a school attendance of the students and the teaching staff who are infected or suspected to be infected, or likely to be infected with a contagious disease as prescribed by the Presidential Decree. <Amended by Act No. 3374, Feb. 28, 1981>

Article 9 (Health Care for Students)

The head of a school shall take measures necessary for the improvement of

physical condition, the care of nutriture, the remedy and prevention of diseases and the prevention of medicine abuse of students. <Amended by Act No. 5618, Dec. 31, 1998>

Article 10 (Inspection of Completion of Vaccination)

(1) The head of an elementary school shall inspect whether the students have taken necessary vaccinations or not, as referred to in Articles 11 and 12 of the Prevention of Contagious Diseases Act, through the certificates of vaccination delivered by the head of Si/Gun/Gu under Article 20 of the said Act, within 90 days after the students enter the school anew.

(2) According to the results of inspection under the provisions of paragraph (1), the head of an elementary school shall guide the studentswho has not completed vaccinations in taking the required vaccinations, and if necessary, may ask the director of a public clinic concerned for necessary cooperation such as the conduct of vaccination.

Article 11 (Remedy and Protective Inoculation)

(1) According to the results of the physical examination under the provisions of Article 7, the head of a school shall take necessary measures for the students who are infected or likely to be infected with diseases in order to remedy and prevent the diseases.

(2) In a case where it is necessary to take such measures as provided in subparagraph 1, the head of a school may ask the director of a public clinic for cooperation, and the director of a public clinic shall not reject this request without any justifiable reason.

Article 12 (Control of Safety of Students)

In order to protect students from any accident which may endanger safety, the head of a school shall check out and improve facilities and equipments in the said school, provide safety education to students, and take other necessary measures.

Article 13 (Health Care for Teaching Staff)

The head of a school shall, if necessary, take necessary measures such as the remedy of diseases and the improvement of working conditionsof the teaching staff according to the results of a physical examination or health examination substituted therefor under Article 7 (1). <Amendedby Act No. 5618, Dec. 31, 1998>

Article 14 (Prevention of Diseases)

A head of a supervisory office may give an order to close the school concerned, if he deems it necessary for the prevention of contagious

diseases and school health, and the head of the school may close his school, if necessary.

Article 14-2 (Executing Vaccinations against Contagious Diseases)

In executing a regular or extra vaccination to students or teaching staff under the provisions of Articles 11 and 12 of the Prevention of Contagious Diseases Act, the head of a Si/Gun/Gu may commission a school physician or a health teacher (limited to a licensed nurse; hereafter the same shall apply in this Article) as personnel for vaccination and have the person execute such vaccination. In this case, the provisions of Article 25 (1) of the Medical Service Act shall not apply to the health

Article 15 (School Physician, School Pharmacist and Health Teacher)

A school physician (including a dentist and a herb doctor), a school pharmacist and a health teacher in charge of the health care of students and teaching staff shall be employed in a school as prescribed by the Presidential Decree. <Amended by Act No. 4349, Mar. 8, 1991; Act No. 6716, Aug. 26, 2002>

Article 14-2 ~ 15

Article 16 (Installation of Health Organizations, etc.)

The organizations and public officers necessary for the school health

care may, pursuant to the Presidential Decree, be employed under the jurisdiction of the Superintendent of the Office of Education or the head of a district office of education. <Amended by Act No. 4349, Mar. 8, 1991; Act No. 5618, Dec. 31, 1998>

Article 17 (School Health Committee)

(1) The School Health Committee shall be established in the Ministry of Education and Human Resources Development in order to deliberate

on important policy about school health. <Amended by Act No. 4268, Dec. 27, 1990; Act No. 6400, Jan. 29, 2001>

(2) The School Health Committee shall consist of not more than 15 members who have experience in school health.

(3) Other matters necessary for the operation of the School Health Committee shall be prescribed by the Presidential Decree.

Article 18 (Supplement of Expenses)

The government shall support the whole or parts of the expenses required for physical examinations as provided in Article 7 (1).

Article 19 (Penal Provisions)

A person who violates the provisions of Article 6 (1) shall be punished by imprisonment for not more than one year or by a fine not exceeding five million won. <Amended by Act No. 5618, Dec. 31, 1998>

(2) (Term of Validity) The amended provisions of Article 6 (1) 5 shall be valid not later than December 31, 2004.

(3) (Special Cases for Establishment of Cleanup Zone) If a foreigners’organization registered with the Ministry of Education and Human Resources Development under Article 39 (1) of the previous Immigration Control Act (the one before the amendment by Act No. 5755) has received an authorization of establishment for a foreigners’ school under Article 60-2 of the Elementary and Secondary Education Act not later than December 31, 2002, the provisions of Article 5 (1) shall not apply.
